AN ACT relating to public schools; requiring the superintendent of public instruction to provide certain information concerning statutes and regulations affecting public schools and pupils to the boards of trustees of school districts; requiring the boards of trustees to provide similar information concerning statutes to parents and educational personnel; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 385.210 is hereby amended to read as follows:

1-2 385.210 1. The superintendent of public instruction shall prescribe a

1-3 convenient form of school register for the purpose of securing accurate

1-4 returns from the teachers of public schools.

1-5 2. The superintendent shall prepare pamphlet copies of the [school

1-6 law,] codified statutes relating to schools, and shall transmit a copy to each

1-7 school, school trustee [,] and other school officer in [the state. When] this

1-8 state. If the state board adopts regulations to carry out these codified

1-9 statutes or if additions or amendments are made to [the school law, he]

1-10 these codified statutes, the superintendent shall have [them] the

1-11 regulations, additions or amendments printed and transmitted immediately

1-12 thereafter. Each pamphlet [shall] must be marked "State property—to be

1-13 turned over to your successor in office." Each school shall maintain a copy

2-1 of the pamphlet with any regulations, additions or amendments in the

2-2 school library.

2-3 3. In addition to the requirements set forth in subsection 2, the

2-4 superintendent shall, not later than July 1 of each year, provide to the

2-5 board of trustees of each school district a memorandum that describes

2-6 each statute newly enacted by the legislature which affects the public

2-7 schools in this state and the pupils who are enrolled in the public schools

2-8 in this state. The memorandum may compile all the statutes into one

2-9 document. If a statute requires the state board to take action to carry out

2-10 the statute, the memorandum must include a brief plan for carrying out

2-11 the statute by the state board. In addition, the memorandum must include

2-12 the date on which the statute becomes effective and the date by which it

2-13 must be carried into effect by a school district or public school.

2-14 4. Not later than 60 days after receipt of such a memorandum from

2-15 the superintendent, the board of trustees of a school district shall

2-16 determine which statutes directly affect pupils, parents, teachers,

2-17 administrators or other educational personnel and require a plan for

2-18 implementation. If the board of trustees determines that a statute

2-19 requires a plan for implementation, the board of trustees shall prepare a

2-20 brief plan, which must ensure that the school district and the public

2-21 schools within the school district will comply with the statute on the date

2-22 on which the statute becomes effective and thereafter. The board of

2-23 trustees shall provide written notice of the information contained in the

2-24 memorandum provided pursuant to subsection 3 that directly affects

2-25 pupils, parents, teachers, administrators or other educational personnel

2-26 and a brief plan for implementation of the statutes, if any, to the parents

2-27 and legal guardians of pupils who are enrolled in public schools within

2-28 the school district and all teachers, administrators and other educational

2-29 personnel who are employed by the board of trustees. The written notice

2-30 to the parents and legal guardians may be:

2-31 (a) Included in other notices that the board of trustees provides to

2-32 parents and legal guardians.

2-33 (b) Provided in a language other than English if the board of trustees

2-34 determines that it is necessary for the parent or legal guardian to

2-35 understand the notice.

2-36 5. The superintendent shall, if directed by the state board, prepare and

2-37 publish a bulletin as the official publication of the department.

2-38 Sec. 2. NRS 386.360 is hereby amended to read as follows:

2-39 386.360 1. The board of trustees of a school district shall ensure

2-40 that all teachers, administrators and other educational personnel who are

2-41 employed by the board of trustees receive information concerning the

2-42 statutes that directly affect the duties and responsibilities of the teachers,

3-1 administrators and other educational personnel in accordance with the

3-2 provisions of subsection 4 of NRS 385.210.

3-3 2. Each board of trustees may prescribe and enforce rules, not

3-4 inconsistent with law or rules prescribed by the state board , [of education,]

3-5 for its own government and the government of public schools under its

3-6 charge.

3-7 [2.] 3. Each board of trustees shall prescribe rules for the granting of

3-8 permission to carry or possess a weapon pursuant to NRS 202.265.

3-9 Sec. 3. The superintendent of public instruction and the board of

3-10 trustees of each school district shall provide information on statutes and

3-11 regulations in accordance with the amendatory provisions of subsections 3

3-12 and 4 of section 1 of this act for all statutes and regulations that are effective

3-13 on or after July 1, 1999.

3-14 Sec. 4. This act becomes effective on August 1, 1999.
