AN ACT relating to public welfare; prohibiting the department of human resources from considering the assets of a child or pregnant woman or their families to determine eligibility for the child health assurance program; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 422 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 The administrator shall not include in the state plan for Medicaid a

1-4 requirement that any resources or assets of a child or pregnant woman or

1-5 the family of the child or pregnant woman be considered to determine

1-6 eligibility for the child health assurance program established pursuant to 42

1-7 U.S.C. § 1396a(a)(10)(A)(i)(IV), (VI) or (VII), unless required to include

1-8 such a consideration pursuant to federal law.

1-9 Sec. 2. NRS 422.222 is hereby amended to read as follows:

1-10 422.222 1. The administrator may adopt such regulations as are

1-11 necessary for the administration of NRS 422.070 to 422.410, inclusive , and

1-12 section 1 of this act and any program of the welfare division.

1-13 2. A regulation adopted by the administrator becomes effective upon

1-14 adoption or such other date as the administrator specifies in the regulation.

1-15 Sec. 3. NRS 232.320 is hereby amended to read as follows:

1-16 232.320 1. Except as otherwise provided in subsection 2, the director:

1-17 (a) Shall appoint, with the consent of the governor, chiefs of the divisions

1-18 of the department, who are respectively designated as follows:

2-1 (1) The administrator of the aging services division;

2-2 (2) The administrator of the health division;

2-3 (3) The state welfare administrator; and

2-4 (4) The administrator of the division of child and family services.

2-5 (b) Shall administer, through the divisions of the department, the

2-6 provisions of chapters 210, 423, 424, 425, 427A, 432A to 442, inclusive, 446,

2-7 447, 449 and 450 of NRS, NRS 127.220 to 127.310, inclusive, 422.070 to

2-8 422.410, inclusive, and section 1 of this act, 432.010 to 432.139, inclusive,

2-9 444.003 to 444.430, inclusive, and 445A.010 to 445A.050, inclusive, and all

2-10 other provisions of law relating to the functions of the divisions of the

2-11 department, but is not responsible for the clinical activities of the health

2-12 division or the professional line activities of the other divisions.

2-13 (c) Shall, after considering advice from agencies of local governments and

2-14 nonprofit organizations which provide social services, adopt a master plan for

2-15 the provision of human services in this state. The director shall revise the plan

2-16 biennially and deliver a copy of the plan to the governor and the legislature at

2-17 the beginning of each regular session. The plan must:

2-18 (1) Identify and assess the plans and programs of the department for the

2-19 provision of human services, and any duplication of those services by federal,

2-20 state and local agencies;

2-21 (2) Set forth priorities for the provision of those services;

2-22 (3) Provide for communication and the coordination of those services

2-23 among nonprofit organizations, agencies of local government, the state and

2-24 the Federal Government;

2-25 (4) Identify the sources of funding for services provided by the

2-26 department and the allocation of that funding;

2-27 (5) Set forth sufficient information to assist the department in providing

2-28 those services and in the planning and budgeting for the future provision of

2-29 those services; and

2-30 (6) Contain any other information necessary for the department to

2-31 communicate effectively with the Federal Government concerning

2-32 demographic trends, formulas for the distribution of federal money and any

2-33 need for the modification of programs administered by the department.

2-34 (d) May, by regulation, require nonprofit organizations and state and local

2-35 governmental agencies to provide information to him regarding the programs

2-36 of those organizations and agencies, excluding detailed information relating

2-37 to their budgets and payrolls, which he deems necessary for his performance

2-38 of the duties imposed upon him pursuant to this section.

2-39 (e) Has such other powers and duties as are provided by law.

2-40 2. The governor shall appoint the administrator of the mental hygiene and

2-41 mental retardation division.

2-42 Sec. 4. This act becomes effective on July 1, 1999.
