AN ACT relating to vessels; authorizing the administrator of the division of wildlife of the

state department of conservation and natural resources to require reimbursement of

certain expenses of the division associated with events involving vessels; and

providing other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 488.305 is hereby amended to read as follows:

  1. 488.305 1. The division of wildlife of the state department of
  1. conservation and natural resources may authorize the holding of regattas,
  1. motorboat or other boat races, marine parades, tournaments or exhibitions
  1. on any waters of this state. The commission shall adopt regulations
  1. concerning the safety of motorboats and other vessels and persons thereon,
  1. either observers or participants.
  1. 2. [Whenever] At least 30 days before a regatta, motorboat or other
  1. boat race, marine parade, tournament or exhibition is proposed to be held,
  1. the person in charge thereof [shall , at least 30 days prior thereto,] must file
  1. an application with the division of wildlife for permission to hold the
  1. regatta, motorboat or other boat race, marine parade, tournament or
  1. exhibition. [It may not] No such event may be conducted without the
  1. written authorization of the division of wildlife.
  1. 3. The administrator of the division of wildlife may require an
  1. applicant, or the sponsor of the event, as a condition of the approval of a
  1. regatta, motorboat or other boat race, marine parade, tournament or
  1. exhibition, to enter into an agreement to reimburse the division for
  1. expenses incurred by the division to ensure that the event is conducted
  1. safely, including, without limitation, expenses for equipment used,
  1. expenses for personnel and general operating expenses.
  1. 4. The application must set forth the date, time and location where it is
  1. proposed to hold the regatta, motorboat or other boat race, marine parade,
  1. tournament or exhibition, the type of vessels participating, the number and
  1. kind of navigational aids required and the name of a person who will be
  1. present at the event to ensure that the conditions of the permit are satisfied.
  1. [4.] 5. The provisions of this section do not exempt any person from
  1. compliance with applicable federal law or regulation.
