AN ACT relating to crimes; imposing community service for a second or subsequent offense of unlawfully parking in a space designated for the handicapped; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 484.408 is hereby amended to read as follows:

1-2 484.408 1. Any parking space designated for the handicapped must

1-3 be indicated by a sign:

1-4 (a) Bearing the international symbol of access with or without the words

1-5 "Parking," "Handicapped Parking," "Handicapped Parking Only," or

1-6 "Reserved for the Handicapped," or any other word or combination of

1-7 words indicating that the space is designated for the handicapped;

1-8 (b) Stating "Minimum fine of $100 for use by others" or equivalent

1-9 words; and

1-10 (c) The bottom of which must be not less than 4 feet above the ground.

1-11 2. A person shall not park a vehicle in a space designated for the

1-12 handicapped by a sign that meets the requirements of subsection 1, whether

1-13 on public or privately owned property, unless he is eligible to do so and the

1-14 vehicle displays:

1-15 (a) Special license plates issued pursuant to NRS 482.384;

1-16 (b) A special or temporary parking placard issued pursuant to NRS

1-17 482.384;

2-1 (c) Special license plates or a special or temporary parking placard

2-2 displaying the international symbol of access issued by another state or a

2-3 foreign country; or

2-4 (d) Special license plates for a disabled veteran and a special parking

2-5 placard issued pursuant to NRS 482.384.

2-6 3. A person shall not use such a plate or placard for a vehicle to park in

2-7 a space designated for the handicapped unless he is a person with a

2-8 disability which limits or impairs the ability to walk, a disabled veteran or

2-9 the driver of a vehicle in which such a person is a passenger.

2-10 4. [Any] A person who violates any provision of this section is guilty

2-11 of a misdemeanor and shall be punished:

2-12 (a) Upon the first offense , by a fine of $100.

2-13 (b) Upon the second offense , by a fine of $250 [.] and not less than 8

2-14 hours, but not more than 50 hours, of community service.

2-15 (c) Upon the third or subsequent offense , by a fine of not less than $500

2-16 [nor] , but not more than $1,000 [.] and not less than 25 hours, but not

2-17 more than 100 hours, of community service.

2-18 Sec. 2. The amendatory provisions of this act do not apply to offenses

2-19 that are committed before October 1, 1999.
