AN ACT relating to bail; requiring a bail agent and bail enforcement agent to notify a local law enforcement agency after apprehending a defendant; requiring a bail agent and bail enforcement agent to notify a local law enforcement agency before forcibly entering an inhabited dwelling; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 697 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. After apprehending a defendant in this state, a bail agent or bail

1-4 enforcement agent shall immediately or without undue delay notify in

1-5 person or by telephone the local law enforcement agency of the

1-6 jurisdiction in which the defendant was apprehended of:

1-7 (a) The identity of the defendant;

1-8 (b) The identity of the bail agent or bail enforcement agent; and

1-9 (c) Where the bail agent or bail enforcement agent is taking the

1-10 defendant to surrender him into custody.

1-11 2. Before forcibly entering an inhabited dwelling in this state, a bail

1-12 agent or bail enforcement agent shall notify the local law enforcement

1-13 agency of the jurisdiction in which the dwelling is located.

2-1 3. A bail agent or bail enforcement agent who violates the provisions

2-2 of this section is guilty of a misdemeanor.

2-3 4. As used in this section, "inhabited dwelling" means any structure,

2-4 building, house, room, apartment, tenement, tent, conveyance, vessel,

2-5 boat, vehicle, house trailer, travel trailer, motor home or railroad car in

2-6 which the owner or other lawful occupant resides.

2-7 Sec. 2. The amendatory provisions of this act do not apply to offenses

2-8 that were committed before the effective date of this act.

2-9 Sec. 3. This act becomes effective upon passage and approval.
