AN ACT relating to local government; requiring a two-thirds vote of the governing body or a majority vote of the registered voters within the jurisdiction of the local government to pass certain ordinances, resolutions or other instruments; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 354 of NRS is hereby amended by adding thereto

1-2 a new section to read as follows:

1-3 1. Except as otherwise provided in subsection 2, an affirmative vote

1-4 of not fewer than two-thirds of all the members of the governing body of

1-5 a local government is necessary to pass an ordinance, resolution or any

1-6 other instrument that creates, generates or increases public revenue in

1-7 any form, including, without limitation, taxes, fees, assessments and

1-8 rates, or changes in the computation bases for taxes, fees, assessments

1-9 and rates.

1-10 2. If two-thirds of the members of the governing body do not approve

1-11 such an ordinance, resolution or other instrument, a majority of the

1-12 members of the governing body may submit the question of whether the

1-13 ordinance, resolution or other instrument should be adopted to the

1-14 registered voters within the jurisdiction of the local government at the

1-15 next general election or next general city election. If a majority of the

2-1 registered voters voting on the question approve the adoption of the

2-2 ordinance, resolution or other instrument, the ordinance, resolution or

2-3 other instrument becomes effective upon completion of the canvass of

2-4 votes or at a later date if such a date is specified in the ordinance,

2-5 resolution or other instrument.

2-6 3. As used in this section, "local government" means a political

2-7 subdivision of this state which is authorized to create, generate or

2-8 increase public revenue, including, without limitation, counties, cities,

2-9 towns, boards, authorities, school districts and other districts organized

2-10 pursuant to chapters 244, 244A, 309, 318, 379, 439, 450, 473, 474, 539,

2-11 541, 543 and 555 of NRS.

2-12 Sec. 2. This act becomes effective on July 1, 1999.
