AN ACT relating to gaming; revising the provisions governing the location of gaming establishments in residential neighborhoods; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Section 20 of chapter 452, Statutes of Nevada 1997, at

1-2 page 1713, is hereby amended to read as follows:

1-3 Sec. 20. 1. A proposed resort hotel:

1-4 [1.] (a) That is located on 25 or more acres of property;

1-5 [2.] (b) That is located in the unincorporated area of the county,

1-6 which has been designated for gaming by the master plan of the

1-7 county; and

1-8 [3.] (c) For which an application for appropriate zoning is

1-9 submitted to the county before June 28, 1997,

1-10 may petition the county, city or town having jurisdiction over the

1-11 location of the proposed establishment to designate the location of

1-12 the proposed establishment a gaming enterprise district pursuant to

1-13 NRS [463.194.] 463.3084.

1-14 2. A proposed resort hotel:

1-15 (a) That is located on 20 or more contiguous acres of property

1-16 that are adjacent to and north of Rancho Drive;

1-17 (b) That is located south of Lake Mead Boulevard and north of

1-18 Holley Lane; and

2-1 (c) That is located within 500 feet from a parcel of land on

2-2 which a licensed resort hotel is operated or located on the

2-3 effective date of this act,

2-4 may petition the county, city or town having jurisdiction over the

2-5 location of the proposed establishment to designate the location of

2-6 the proposed establishment a gaming enterprise district pursuant

2-7 to NRS 463.3084.

2-8 3. A proposed resort hotel:

2-9 (a) That is located on 15 or more contiguous acres of property

2-10 that are adjacent to and west of Boulder Highway;

2-11 (b) That is located south of Sahara Avenue and north of

2-12 Desert Inn Road; and

2-13 (c) That is located within 500 feet from a parcel of land on

2-14 which a licensed resort hotel is operated or located on the

2-15 effective date of this act,

2-16 may petition the county, city or town having jurisdiction over the

2-17 location of the proposed establishment to designate the location of

2-18 the proposed establishment a gaming enterprise district pursuant

2-19 to NRS 463.3084.

2-20 Sec. 2. If any provision of this act is held invalid, each provision of

2-21 this act is invalid, and to this end the provisions of this act are

2-22 nonseverable.

2-23 Sec. 3. This act becomes effective upon passage and approval.
