AN ACT relating to firearms; providing that certain lawsuits against a manufacturer or dealer of firearms or ammunition or a trade association related to firearms or ammunition by a governmental entity may be brought only by the State of Nevada; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 12 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in subsection 2, the State of Nevada

1-4 is the only governmental entity in this state that may commence a lawsuit

1-5 against a manufacturer or distributor of a firearm or ammunition or a

1-6 trade association related to firearms or ammunition for damages,

1-7 abatement or injunctive relief resulting from or relating to the lawful

1-8 design or manufacture of a firearm or ammunition or the marketing or

1-9 sale of a firearm or ammunition to the public.

1-10 2. The provisions of this section do not prohibit a county, city, local

1-11 government or other political subdivision of this state or an agency

1-12 thereof from commencing a lawsuit against a manufacturer or

1-13 distributor of a firearm or ammunition for breach of contract or

1-14 warranty concerning a firearm or ammunition purchased by the county,

1-15 city, local government or other political subdivision of this state or

1-16 agency thereof.

2-1 Sec. 2. The provisions of this act apply to any action that is pending

2-2 on or brought on or after October 1, 1999.
