AN ACT relating to the City of North Las Vegas; revising the provisions of the North Las Vegas City Charter regarding the election of city councilmen; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Section 2.010 of the charter of the City of North Las

1-2 Vegas, being chapter 573, Statutes of Nevada 1971, as last amended by

1-3 chapter 215, Statutes of Nevada 1997, at page 748, is hereby amended to

1-4 read as follows:

1-5 Sec. 2.010 City council: Qualifications; election; term of

1-6 office; salary.

1-7 1. The legislative power of the city is vested in a city council

1-8 consisting of four councilmen and a mayor.

1-9 2. The mayor and councilmen must be:

1-10 (a) Bona fide residents of the city for at least 6 months

1-11 immediately preceding their election.

1-12 (b) Qualified electors within the city.

1-13 3. At the time of filing, if so required by an ordinance duly

1-14 enacted, candidates for the office of mayor and councilman shall

1-15 produce evidence in satisfaction of any or all of the qualifications

1-16 provided in subsection 2.

1-17 4. [All councilmen, including the mayor,] The councilmen

1-18 must be voted upon by the registered voters of the city at large [,]

1-19 according to the particular city council seat for which they

2-1 declared their candidacy pursuant to section 5.020 of this charter,

2-2 and their terms of office are 4 years.

2-3 5. The mayor must be voted upon by the registered voters of

2-4 the city at large, and his term of office is 4 years.

2-5 6. The mayor and councilmen are entitled to receive a salary in

2-6 an amount fixed by the city council.

2-7 Sec. 2. Section 5.020 of the charter of the City of North Las Vegas,

2-8 being chapter 573, Statutes of Nevada 1971, as last amended by chapter

2-9 215, Statutes of Nevada 1997, at page 748, is hereby amended to read as

2-10 follows:

2-11 Sec. 5.020 Primary municipal elections; declaration of

2-12 candidacy.

2-13 1. The city council shall provide by ordinance for candidates

2-14 for elective office to declare their candidacy and file the necessary

2-15 documents. The city council seats must be designated by the

2-16 numbers one through four for election purposes. A candidate for

2-17 the office of city councilman shall include in his declaration of

2-18 candidacy the number of the city council seat for which he is a

2-19 candidate.

2-20 2. If for any general municipal election there are three or more

2-21 candidates for the offices of mayor or municipal judge, or [five or

2-22 more candidates for the office of councilman,] for a particular city

2-23 council seat, a primary election for any such office must be held on

2-24 the Tuesday following the first Monday in May preceding the

2-25 general election.

2-26 3. Except as otherwise provided in [subsections 4 and 5,]

2-27 subsection 4, after the primary election, the names of the two

2-28 candidates for mayor , [and] municipal judge and [the names of the

2-29 four candidates for city councilman] each city council seat who

2-30 receive the highest number of votes must be placed on the ballot for

2-31 the general election.

2-32 4. If one of the candidates for mayor , [or] municipal judge or

2-33 a city council seat receives a majority of the total votes cast for that

2-34 office in the primary election, he shall be declared elected to office

2-35 and his name must not appear on the ballot for the general election.

2-36 [5. If a candidate for city council receives votes equal to a

2-37 majority of voters casting ballots in the primary election:

2-38 (a) He shall be declared elected to one of the open seats on the

2-39 city council and his name must not appear on the ballot for the

2-40 general election.

2-41 (b) Unless all the open seats were filled pursuant to paragraph

2-42 (a), the names of those candidates who received the highest number

2-43 of votes but did not receive a number of votes equal to a majority

3-1 of the voters casting ballots in the primary election, not to exceed

3-2 twice the number of candidates remaining to be elected, must be

3-3 placed on the ballot for the general election.]

3-4 Sec. 3. As soon as is practicable after October 1, 1999, the four city

3-5 councilmen who hold seats on the city council of the City of North Las

3-6 Vegas shall draw lots to determine the number of the city council seat that

3-7 each of them holds.
