THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 201 of NRS is hereby amended by adding thereto a1-2
new section to read as follows:1-3
1. Except as otherwise provided in this subsection, in a prosecution1-4
for a violation of NRS 201.020, the defendant may claim as an1-5
affirmative defense that he was unable to provide the child support or1-6
spousal support ordered by a court.1-7
2. In addition to the written notice required by NRS 174.234, a1-8
defendant who intends to offer the affirmative defense described in1-9
subsection 1 shall, not less than 20 days before trial or at such other time1-10
as the court directs, file and serve upon the prosecuting attorney a written1-11
notice of his intent to claim the affirmative defense. The written notice1-12
must include:1-13
(a) The specific affirmative defense that the defendant is asserting;1-14
and1-15
(b) The name and last known address of each witness by whom the1-16
defendant proposes to establish the affirmative defense.2-1
3. Not later than 10 days after receiving the written notice set forth in2-2
subsection 2 or at such other time as the court directs, the prosecuting2-3
attorney shall file and serve upon the defendant a written notice that2-4
includes the name and last known address of each witness the2-5
prosecuting attorney proposes to offer in rebuttal at trial to discredit the2-6
affirmative defense claimed by the defendant.2-7
4. Each party has a continuing duty to file and serve upon the2-8
opposing party any change in the last known address of any witness that2-9
the party proposes to offer to establish or discredit the affirmative defense2-10
described in subsection 1.2-11
5. Each party has a continuing duty to disclose promptly the names2-12
and last known addresses of any additional witnesses which come to the2-13
attention of that party and which that party proposes to offer to establish2-14
or discredit the affirmative defense described in subsection 1.2-15
6. If the defendant or prosecuting attorney fails to comply with the2-16
requirements set forth in this section, in addition to any sanctions or2-17
protective orders otherwise provided in chapter 174 of NRS, the court2-18
may grant a continuance to permit the opposing party time to prepare.2-19
7. A prosecuting attorney shall provide notice of the requirements of2-20
this section to a defendant when a complaint is served upon the2-21
defendant for a violation of NRS 201.020.2-22
8. For the purposes of this section, a defendant is not "unable to2-23
provide the child support or spousal support ordered by a court" if,2-24
during the period that the defendant was obligated to provide and failed2-25
to provide child support or spousal support, the defendant was:2-26
(a) Voluntarily unemployed or underemployed without good cause or2-27
to avoid payment of child support or spousal support, including, without2-28
limitation, not using reasonable diligence to secure sufficient2-29
employment; or2-30
(b) Unable to pay the child support or spousal support ordered by a2-31
court because of his excessive spending, indebtedness or other legal2-32
obligation, unless the spending, indebtedness or other legal obligation2-33
was not within the control of the defendant.2-34
Sec. 2. NRS 201.015 is hereby amended to read as follows:2-35
201.015 For the purposes of NRS 201.020 to 201.080, inclusive, and2-36
section 1 of this act, "minor child" means a person who has not reached the2-37
age of majority as provided in NRS 129.010 and has not been declared2-38
emancipated pursuant to NRS 129.080 to 129.140, inclusive.2-39
Sec. 3. NRS 201.020 is hereby amended to read as follows: 201.020 1.2-41

2. A person who violates the provisions of subsection 1 is guilty of a3-23
category C felony and shall be punished as provided in NRS 193.1303-24

(a) His arrearages for nonpayment of the child support or spousal3-30
support ordered by a court total $10,000 or more and have accrued over3-31
any period since the date that a court first ordered the defendant to3-32
provide for such support; or3-33
(b) It is a second or subsequent violation of subsection 1 or an offense3-34
committed in another jurisdiction that, if committed in this state, would3-35
be a violation of subsection 1, and his arrearages for nonpayment of the3-36
child support or spousal support ordered by a court total $5,000 or more3-37
and have accrued over any period since the date that a court first ordered3-38
the defendant to provide for such support.3-39
3. A prosecution for a violation of subsection 1 may be brought in a3-40
court of competent jurisdiction in any county in which:3-41
(a) A court has issued a valid order for the defendant to pay child3-42
support or spousal support;3-43
(b) The defendant resides;4-1
(c) The custodial parent or custodian of the child for whom the4-2
defendant owes child support resides;4-3
(d) The spouse or former spouse to whom the defendant owes spousal4-4
support resides; or4-5
(e) The child for whom the defendant owes child support resides.4-6
Sec. 4. NRS 201.030 is hereby amended to read as follows: 201.030 Proceedings under NRS 201.020 to 201.080, inclusive, may4-8
be instituted upon complaint made under oath or affirmation by the spouse4-9
or child or children, or by any other person, including the district attorney ,4-10

Sec. 5. NRS 201.070 is hereby amended to read as follows: 201.070 1. No other or greater evidence is required to prove the4-14
marriage of the husband and wife, or that the defendant is the father or4-15
mother of the child or children, than is required to prove such facts in a4-16
civil action.4-17
2. In no prosecution under NRS 201.020 to 201.080, inclusive, does4-18
any existing statute or rule of law prohibiting the disclosure of confidential4-19
communications between husband and wife apply, and both husband and4-20
wife are competent witnesses to testify against each other to any and all4-21
relevant matters, including the fact of the marriage and the parentage of any4-22
child or children ,4-23
incriminating himself or herself.4-24

1. The natural mother may be established by proof of her having given4-32
birth to the child, or under this chapter, or NRS 125B.150 or 130.701 .4-33

2. The natural father may be established under this chapter, or NRS4-35
125B.150, 130.7014-36
3. An adoptive parent may be established by proof of adoption.4-37
Sec. 7. NRS 201.025, 201.040, 201.050 and 201.060 are hereby4-38
repealed.4-39
Sec. 8. The amendatory provisions of this act do not apply to offenses4-40
committed before October 1, 1999.

TEXT OF REPEALED SECTIONS

201.025 District attorney to establish parentage of child and take5-3
legal action against deserting or nonsupporting parent.5-4
1. The district attorney of the county of residence of a spouse or minor5-5
child who has been deserted, neglected or for whom support and5-6
maintenance are refused as prescribed by NRS 201.020 shall take such5-7
action as is necessary to establish the parentage of such child and locate,5-8
apprehend and take legal action against the deserting or nonsupporting5-9
parent.5-10
2. In a county where the district attorney has deputies to aid him in the5-11
performance of his duties, such district attorney shall designate himself or a5-12
particular deputy as responsible for performing the duties imposed by5-13
subsection 1. 201.040 Temporary order for support. Notwithstanding provisions5-15
to the contrary in a premarital agreement between the spouses which is5-16
otherwise enforceable pursuant to chapter 123A of NRS, at any time before5-17
proceedings are conducted pursuant to NRS 201.020 to 201.080, inclusive,5-18
upon petition of the complainant and upon notice to the defendant, the5-19
court may enter such a temporary order as seems just, providing for support5-20
of the deserted spouse or children, or both, pendente lite, and may punish5-21
for the violation of such an order as for contempt. 201.050 Powers of court in addition to imposition of criminal5-23
penalty; recognizance of defendant.5-24
1. Before the trial, with the consent of the defendant, or at the trial, on5-25
entry of a plea of guilty or guilty but mentally ill, or after conviction,5-26
instead of imposing the penalty provided in NRS 201.020, or in addition5-27
thereto, the court, having regard to the circumstances and to the financial5-28
ability or earning capacity of the defendant, may:5-29
(a) Make an order, which is subject to change by the court from time to5-30
time as circumstances may require, directing the defendant to pay a certain5-31
sum periodically, for a term not exceeding 2 years, to the spouse or the5-32
guardian, curator or custodian of the minor child or children, or to an5-33
organization or natural person approved by the court as trustee.5-34
(b) Release the defendant from custody on probation for the period so5-35
fixed, upon his or her entering into a recognizance, with or without surety,5-36
in such sum as the court may order and approve.5-37
2. The condition of the recognizance must be such that if the defendant5-38
makes his personal appearance in court whenever ordered to do so, and6-1
complies with the terms of the order of support, or of any subsequent6-2
modification thereof, then the recognizance is void. 201.060 Trial of defendant upon proof of violation of court order.6-4
If the court is satisfied by information and due proof, under oath, that at any6-5
time during the period of 2 years the defendant has violated the terms of6-6
such order, it may forthwith proceed with the trial of the defendant under6-7
the original charge, or sentence him or her under the original conviction.~
