AN ACT relating to the charter of the City of Las Vegas; revising provisions governing the

description of the territory of the City of Las Vegas; placing the city auditor under

the direction and supervision of the city council; and providing other matters

properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

  1. Section 1. Section 1.120 of the charter of the City of Las Vegas, being
  1. chapter 517, Statutes of Nevada 1983, at page 1392, is hereby amended to
  1. read as follows:
  1. Sec. 1.120 Incorporation of city; description of territory.
  1. 1. All persons who are inhabitants of that portion of the state
  1. which is embraced within the limits set forth in subsection 2 [of this
  1. charter] constitute a political and corporate body by the name of
  1. "City of Las Vegas," and by that name they and their successors
  1. must be known in law and have perpetual succession.
  1. 2. The territory which is embraced in the city is that certain
  1. land which is described in the official plat which is required by
  1. NRS 234.250 to be filed with the county recorder and county
  1. assessor, as [this plat is] the plat may be revised from time to time .
  1. [pursuant to NRS 268.600.]
  1. Sec. 2. Section 3.170 of the charter of the City of Las Vegas, being
  1. chapter 517, Statutes of Nevada 1983, at page 1410, is hereby amended to
  1. read as follows:
  1. Sec. 3.170 City auditor: Duties.
  1. 1. The [director of financial management may recommend, for
  1. appointment by the city manager, a city auditor.] city council shall
  1. appoint a city auditor and fix the salary of that office.
  1. 2. The city auditor shall report directly to the city council, or
  1. to a committee designated by the city council, and shall perform
  1. such duties as may be designated by the [director of financial
  1. management] city council or prescribed by ordinance.
  1. Sec. 3. Section 3.180 of the charter of the City of Las Vegas, being
  1. chapter 517, Statutes of Nevada 1983, as amended by chapter 45, Statutes
  1. of Nevada 1991, at page 93, is hereby amended to read as follows:
  1. Sec. 3.180 Appointive officers: Qualification; duties restricted
  1. and altered.
  1. 1. The city council may prescribe by ordinance the
  1. qualifications, powers and duties of all appointive officers of the
  1. city, if those qualifications, powers and duties have not been
  1. established by this charter, and may add to, alter or restrict those
  1. qualifications, powers and duties from time to time.
  2. 2. The city manager may designate additional qualifications,
  1. powers and duties of all of the appointive city officers, except the
  1. city attorney [,] and city auditor, which are not in conflict with the
  1. provisions of this charter or any ordinance which prescribes those
  1. qualifications, powers and duties, as he deems necessary or
  1. appropriate , and may add to, alter or restrict those qualifications,
  1. powers and duties from time to time.
  1. Sec. 4. Section 3.210 of the charter of the City of Las Vegas, being
  1. chapter 517, Statutes of Nevada 1983, as amended by chapter 45, Statutes
  1. of Nevada 1991, at page 94, is hereby amended to read as follows:
  1. Sec. 3.210 Appointive officers: Removal.
  1. 1. Except as otherwise provided in subsection 2, each
  1. appointive officer serves at the pleasure of the city manager and
  1. may be removed by him at any time, subject to ratification by the
  1. city council.
  1. 2. The city attorney [serves] and city auditor serve at the
  1. pleasure of the city council and may be removed by an affirmative
  1. vote of a majority of the entire membership of the city council at
  1. any time.
  1. Sec. 5. Section 3.220 of the charter of the City of Las Vegas, being
  1. chapter 517, Statutes of Nevada 1983, as amended by chapter 45, Statutes
  1. of Nevada 1991, at page 94, is hereby amended to read as follows:
  1. Sec. 3.220 Appointive officers: Performance of duties; salary.
  1. 1. All appointive officers of the city, except the city manager,
  1. city attorney , city auditor and the board of civil service trustees,
  1. must have such qualifications and powers and shall perform such
  1. duties, under the direction of the city manager, as may be
  1. designated by the city manager or are prescribed, conferred or
  1. imposed by ordinance, this charter or general law.
  1. 2. All appointive officers of the city and their deputies, except
  1. the city attorney [,] and city auditor, must receive such salary as
  1. may be designated by the city manager within the salary ranges
  1. which have been established for their respective positions by the
  1. city council.
  1. Sec. 6. Section 3.230 of the charter of the City of Las Vegas, being
  1. chapter 517, Statutes of Nevada 1983, as amended by chapter 45, Statutes
  1. of Nevada 1991, at page 94, is hereby amended to read as follows:
  1. Sec. 3.230 Appointive officers; city manager’s direction;
  1. administration of departments. All departments, offices and
  1. agencies, except the city manager, city attorney , city auditor and
  1. the board of civil service trustees, are under the general direction
  1. and supervision of the city manager and must be administered by an
  1. officer who is subject to the immediate direction and supervision of
  1. the city manager. With the consent of the city council, the city
  1. manager may serve also as the director of one or more departments,
  2. offices or agencies and may appoint one person to be the director of
  1. two or more departments, offices or agencies.

Sec. 7. This act becomes effective upon passage and approval.
