THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Section 4 of chapter 333, Statutes of Nevada 1997, at page1-2
1229, is hereby amended to read as follows: Sec. 4. 1. There is hereby created an advisory committee for1-4
the statewide automated system of information concerning pupils.1-5
The advisory committee consists of:1-6
(a) Representatives of school districts. The board of trustees of1-7
each school district shall each appoint one representative.1-8
(b) Two representatives of the state board of education,1-9
appointed by the president of the board.1-10
(c) One representative of the budget division of the department1-11
of administration, appointed by the chief of the budget division.1-12
(d) Two members of the legislature. One of the members must1-13
be appointed by the majority leader of the senate and one of the1-14
members must be appointed by the speaker of the assembly.2-1
2. The term of each member of the advisory committee2-2
commences on August 1, 1997, and expires on June 30,2-3
2001.2-4
3. For each day or portion of a day during which a member2-5
of the advisory committee who is a legislator attends a meeting of2-6
the advisory committee or is otherwise engaged in the business of2-7
the advisory committee, except during a regular or special session2-8
of the legislature, he is entitled to receive the:2-9
(a) Compensation provided for a majority of the members of2-10
the legislature during the first 60 days of the preceding session;2-11
(b) Per diem allowance provided for state officers and2-12
employees generally; and2-13
(c) Travel expenses provided pursuant to NRS 218.2207.2-14
The compensation, per diem allowances and travel expenses of2-15
the legislative members of the advisory committee must be paid2-16
from the legislative fund.2-17
4. The members of the advisory committee who are not2-18
legislators serve without compensation, except that for each day or2-19
portion of a day during which a member of the advisory committee2-20
attends a meeting of the advisory committee or is otherwise2-21
engaged in the work of the advisory committee, he is entitled to2-22
receive the per diem allowance and travel expenses provided for2-23
state officers and employees generally.2-24

least eight meetings with the advisory committee and during those2-26
meetings report to and consider any suggestions of the advisory2-27
committee concerning the establishment and maintenance of the2-28
statewide automated system of information concerning pupils.2-29
Sec. 2. 1. There is hereby appropriated from the state general fund2-30
to the Department of Education the sum of $10,691,280 for the2-31
establishment and maintenance of a statewide automated system of2-32
information concerning pupils pursuant to NRS 386.650.2-33
2. The appropriation made by subsection 1 must be used in accordance2-34
with the programs established by each school district for the statewide2-35
automated system of information concerning pupils pursuant to NRS2-36
386.650 in the following manner:2-37
(a) A sum not to exceed $960,000 may be used by the Department of2-38
Education for:2-39
(1) Contractual services that are necessary to plan, install and2-40
evaluate hardware and software and provide technical assistance for the2-41
statewide automated system of information concerning pupils; and3-1
(2) The payment of the per diem allowances and travel expenses for3-2
the members of the advisory committee for the statewide automated system3-3
of information concerning pupils who are not legislators.3-4
(b) The remaining balance of the appropriation must be distributed to3-5
the Clark County School District for the purchase of hardware, networking3-6
and software for information relating to pupils, and training and other3-7
related services that are nonrecurring, including, without limitation,3-8
assistance in the integration of the statewide automated system of3-9
information concerning pupils.3-10
3. To receive money pursuant to subsection 2, the board of trustees of3-11
the Clark County School District shall enter into a written agreement with3-12
the Department of Education. The written agreement must prescribe the3-13
duties of the school district and the Department of Education in3-14
establishing and maintaining the statewide automated system of3-15
information concerning pupils. The Clark County School District shall not3-16
use the money to:3-17
(a) Settle or arbitrate disputes or negotiate settlements between an3-18
organization that represents employees of the school district and the school3-19
district; or3-20
(b) Adjust the schedules of salaries and benefits of the employees of the3-21
school district, excluding any overtime costs incurred by an employee of3-22
the school district while working on the establishment and maintenance of3-23
the statewide automated system of information concerning pupils.3-24
4. Any remaining balance of the appropriation made by subsection 13-25
must not be committed for expenditure after June 30, 2001, and reverts to3-26
the state general fund as soon as all payments of money committed have3-27
been made.3-28
Sec. 3. 1. There is hereby appropriated from the state general fund3-29
to the Department of Education the sum of $4,088,802.3-30
2. The Department of Education shall distribute the appropriation3-31
made by subsection 1 to all school districts, excluding the Clark County3-32
School District, for the ongoing costs of maintenance associated with the3-33
statewide automated system of information concerning pupils.3-34
3. To receive money pursuant to subsection 2, the board of trustees of3-35
a school district shall enter into a written agreement with the Department3-36
of Education. The written agreement must prescribe the duties of the3-37
school district and the Department of Education in maintaining the3-38
statewide automated system of information concerning pupils. A school3-39
district shall not use the money to:3-40
(a) Settle or arbitrate disputes or negotiate settlements between an3-41
organization that represents employees of the school district and the school3-42
district; or4-1
(b) Adjust the schedules of salaries and benefits of the employees of the4-2
school district, excluding any overtime costs incurred by an employee of4-3
the school district while working on the maintenance of the statewide4-4
automated system of information concerning pupils.4-5
4. Any remaining balance of the appropriation made by subsection 14-6
must not be committed for expenditure after June 30, 2001, and reverts to4-7
the state general fund as soon as all payments of money committed have4-8
been made.4-9
Sec. 4. 1. The Superintendent of Public Instruction shall report4-10
semiannually during the 1999-2001 biennium to the interim finance4-11
committee concerning the expenditures described in sections 2 and 3 of4-12
this act.4-13
2. The Department of Education shall, on or before February 15, 2001,4-14
report to the 71st session of the Nevada Legislature on all expenditures4-15
described in sections 2 and 3 of this act.4-16
Sec. 5. For the purposes of carrying out the provisions of this act, the4-17
Department of Education is not subject to the provisions of chapter 233F4-18
or 242 of NRS.4-19
Sec. 6. 1. This section and sections 2 and 3 of this act become4-20
effective upon passage and approval.4-21
2. Sections 1, 4 and 5 of this act become effective on July 1, 1999.~
