AN ACT relating to education; extending the prospective expiration of the advisory committee for the statewide automated system of information concerning pupils; revising provisions governing the payment of the expenses of the members of the advisory committee; making appropriations to the Department of Education for the statewide automated system of information concerning pupils; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Section 4 of chapter 333, Statutes of Nevada 1997, at page

1-2 1229, is hereby amended to read as follows:

1-3 Sec. 4. 1. There is hereby created an advisory committee for

1-4 the statewide automated system of information concerning pupils.

1-5 The advisory committee consists of:

1-6 (a) Representatives of school districts. The board of trustees of

1-7 each school district shall each appoint one representative.

1-8 (b) Two representatives of the state board of education,

1-9 appointed by the president of the board.

1-10 (c) One representative of the budget division of the department

1-11 of administration, appointed by the chief of the budget division.

1-12 (d) Two members of the legislature. One of the members must

1-13 be appointed by the majority leader of the senate and one of the

1-14 members must be appointed by the speaker of the assembly.

2-1 2. The term of each member of the advisory committee

2-2 commences on August 1, 1997, and expires on June 30, [1999.]

2-3 2001.

2-4 3. For each day or portion of a day during which a member

2-5 of the advisory committee who is a legislator attends a meeting of

2-6 the advisory committee or is otherwise engaged in the business of

2-7 the advisory committee, except during a regular or special session

2-8 of the legislature, he is entitled to receive the:

2-9 (a) Compensation provided for a majority of the members of

2-10 the legislature during the first 60 days of the preceding session;

2-11 (b) Per diem allowance provided for state officers and

2-12 employees generally; and

2-13 (c) Travel expenses provided pursuant to NRS 218.2207.

2-14 The compensation, per diem allowances and travel expenses of

2-15 the legislative members of the advisory committee must be paid

2-16 from the legislative fund.

2-17 4. The members of the advisory committee who are not

2-18 legislators serve without compensation, except that for each day or

2-19 portion of a day during which a member of the advisory committee

2-20 attends a meeting of the advisory committee or is otherwise

2-21 engaged in the work of the advisory committee, he is entitled to

2-22 receive the per diem allowance and travel expenses provided for

2-23 state officers and employees generally.

2-24 [4.] 5. The superintendent of public instruction shall hold at

2-25 least eight meetings with the advisory committee and during those

2-26 meetings report to and consider any suggestions of the advisory

2-27 committee concerning the establishment and maintenance of the

2-28 statewide automated system of information concerning pupils.

2-29 Sec. 2. 1. There is hereby appropriated from the state general fund

2-30 to the Department of Education the sum of $10,691,280 for the

2-31 establishment and maintenance of a statewide automated system of

2-32 information concerning pupils pursuant to NRS 386.650.

2-33 2. The appropriation made by subsection 1 must be used in accordance

2-34 with the programs established by each school district for the statewide

2-35 automated system of information concerning pupils pursuant to NRS

2-36 386.650 in the following manner:

2-37 (a) A sum not to exceed $960,000 may be used by the Department of

2-38 Education for:

2-39 (1) Contractual services that are necessary to plan, install and

2-40 evaluate hardware and software and provide technical assistance for the

2-41 statewide automated system of information concerning pupils; and

3-1 (2) The payment of the per diem allowances and travel expenses for

3-2 the members of the advisory committee for the statewide automated system

3-3 of information concerning pupils who are not legislators.

3-4 (b) The remaining balance of the appropriation must be distributed to

3-5 the Clark County School District for the purchase of hardware, networking

3-6 and software for information relating to pupils, and training and other

3-7 related services that are nonrecurring, including, without limitation,

3-8 assistance in the integration of the statewide automated system of

3-9 information concerning pupils.

3-10 3. To receive money pursuant to subsection 2, the board of trustees of

3-11 the Clark County School District shall enter into a written agreement with

3-12 the Department of Education. The written agreement must prescribe the

3-13 duties of the school district and the Department of Education in

3-14 establishing and maintaining the statewide automated system of

3-15 information concerning pupils. The Clark County School District shall not

3-16 use the money to:

3-17 (a) Settle or arbitrate disputes or negotiate settlements between an

3-18 organization that represents employees of the school district and the school

3-19 district; or

3-20 (b) Adjust the schedules of salaries and benefits of the employees of the

3-21 school district, excluding any overtime costs incurred by an employee of

3-22 the school district while working on the establishment and maintenance of

3-23 the statewide automated system of information concerning pupils.

3-24 4. Any remaining balance of the appropriation made by subsection 1

3-25 must not be committed for expenditure after June 30, 2001, and reverts to

3-26 the state general fund as soon as all payments of money committed have

3-27 been made.

3-28 Sec. 3. 1. There is hereby appropriated from the state general fund

3-29 to the Department of Education the sum of $4,088,802.

3-30 2. The Department of Education shall distribute the appropriation

3-31 made by subsection 1 to all school districts, excluding the Clark County

3-32 School District, for the ongoing costs of maintenance associated with the

3-33 statewide automated system of information concerning pupils.

3-34 3. To receive money pursuant to subsection 2, the board of trustees of

3-35 a school district shall enter into a written agreement with the Department

3-36 of Education. The written agreement must prescribe the duties of the

3-37 school district and the Department of Education in maintaining the

3-38 statewide automated system of information concerning pupils. A school

3-39 district shall not use the money to:

3-40 (a) Settle or arbitrate disputes or negotiate settlements between an

3-41 organization that represents employees of the school district and the school

3-42 district; or

4-1 (b) Adjust the schedules of salaries and benefits of the employees of the

4-2 school district, excluding any overtime costs incurred by an employee of

4-3 the school district while working on the maintenance of the statewide

4-4 automated system of information concerning pupils.

4-5 4. Any remaining balance of the appropriation made by subsection 1

4-6 must not be committed for expenditure after June 30, 2001, and reverts to

4-7 the state general fund as soon as all payments of money committed have

4-8 been made.

4-9 Sec. 4. 1. The Superintendent of Public Instruction shall report

4-10 semiannually during the 1999-2001 biennium to the interim finance

4-11 committee concerning the expenditures described in sections 2 and 3 of

4-12 this act.

4-13 2. The Department of Education shall, on or before February 15, 2001,

4-14 report to the 71st session of the Nevada Legislature on all expenditures

4-15 described in sections 2 and 3 of this act.

4-16 Sec. 5. For the purposes of carrying out the provisions of this act, the

4-17 Department of Education is not subject to the provisions of chapter 233F

4-18 or 242 of NRS.

4-19 Sec. 6. 1. This section and sections 2 and 3 of this act become

4-20 effective upon passage and approval.

4-21 2. Sections 1, 4 and 5 of this act become effective on July 1, 1999.
