AN ACT relating to pari-mutuel wagering; revising the prohibition against rebates and incentives under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 464.075 is hereby amended to read as follows:

1-2 464.075 1. A person who is licensed to engage in off-track pari-

1-3 mutuel wagering shall not:

1-4 (a) Accept from a patron less than the full face value of an off-track

1-5 pari-mutuel wager;

1-6 (b) Agree to refund or rebate to a patron any portion or percentage of

1-7 the full face value of an off-track pari-mutuel wager; [or]

1-8 (c) Increase the payoff of, or pay a bonus on, a winning off-track pari-

1-9 mutuel wager [.] ; or

1-10 (d) Provide any other incentive,

1-11 if the race upon which the wager is placed occurs in a jurisdiction that

1-12 prohibits such an acceptance, agreement, increase or incentive.

1-13 2. A person who is licensed to engage in off-track pari-mutuel

1-14 wagering and who:

1-15 (a) Attempts to evade the provisions of subsection 1 by offering to a

1-16 patron a wager that is not posted and offered to all patrons; or

1-17 (b) Otherwise violates the provisions of subsection 1,

2-1 is subject to the investigatory and disciplinary proceedings that are set forth

2-2 in NRS 463.310 to 463.318, inclusive, and shall be punished as provided in

2-3 those sections.

2-4 3. The Nevada gaming commission shall adopt regulations to carry out

2-5 the provisions of this section.

2-6 Sec. 2. This act becomes effective on July 1, 1999.
