CHAPTER........
AN ACT relating to gaming; revising the provisions governing the imposition of the casino
entertainment tax on certain service charges; prohibiting certain persons from
entering into contracts or agreements with a licensee; authorizing a rehearing on a
claim for a refund of gaming license fees or taxes; and providing other matters
properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. Chapter 463 of NRS is hereby amended by adding thereto a
new section to read as follows:
1. A person who has:
(a) Been denied a license by the commission;
(b) Been found unsuitable by the commission; or
(c) Had a license or finding of suitability revoked by the
commission,
shall not enter or attempt to enter into any contract or agreement with a
licensee, either directly or indirectly, through any business organization
under such a person’s control, that involves the operations of a licensee
without the prior approval of the commission. This provision does not
prohibit any person from purchasing any goods or services for personal
use from a licensee at retail prices that are available to the general
public.
2. Every contract or agreement with a person that is subject to the
provisions of subsection 1 shall be deemed to include a provision for its
termination without liability on the part of the licensee. Failure to
expressly include that condition in the contract or agreement is not a
defense in any action brought pursuant to this section to terminate the
agreement.
3. Any person, contract or agreement subject to the provisions of
subsection 1 is subject to being enjoined pursuant to and in accordance
with the provisions of NRS 463.346.
Sec. 2. NRS 463.165 is hereby amended to read as follows:

4. The name of any person determined to be unsuitable pursuant to
this section must be included on the list required pursuant to subsection 8
of NRS 463.165.
Sec. 4. NRS 463.387 is hereby amended to read as follows:
[7.] 8. The provisions of this chapter must not be construed to permit
the proration of state gaming taxes or license fees for purposes of a refund.

Sec. 8. This act becomes effective upon passage and approval.
