AN ACT relating to the department of motor vehicles and public safety; authorizing the use of digital images on drivers’ licenses and identification cards; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 483 of NRS is hereby amended by adding thereto

1-2 a new section to read as follows:

1-3 "Photograph" includes a digital image created by a computer or

1-4 digital camera.

1-5 Sec. 2. NRS 483.020 is hereby amended to read as follows:

1-6 483.020 As used in NRS 483.010 to 483.630, inclusive, and section 1

1-7 of this act, unless the context otherwise requires, the words and terms

1-8 defined in NRS 483.025 to 483.190, inclusive, and section 1 of this act,

1-9 have the meanings ascribed to them in those sections.

1-10 Sec. 3. NRS 483.347 is hereby amended to read as follows:

1-11 483.347 1. Except as otherwise provided in subsection 2, the

1-12 department shall issue a driver’s license which [:

1-13 (a) Bears] bears a front view colored photograph of the licensee if he is

1-14 21 years of age or older, or a profile view colored photograph if he is

1-15 under 21 years of age . [; and

2-1 (b) May be obtained immediately by any applicant upon qualifying

2-2 therefor, unless the applicant’s current driving record is not immediately

2-3 available at the issuing office.]

2-4 2. The department may issue a temporary driver’s license without a

2-5 photograph of the licensee if the licensee is temporarily absent from this

2-6 state and requests the renewal of, the issuance of a duplicate of, or a

2-7 change in the information on, his driver’s license. If the licensee returns to

2-8 this state for 14 continuous days or more, the licensee shall, within 24 days

2-9 after the date of his return, surrender the temporary license and obtain a

2-10 license which bears his photograph in accordance with subsection 1.

2-11 [However, a] A licensee charged with violating the provisions of this

2-12 subsection may not be convicted if he surrenders the temporary license,

2-13 obtains a license which bears his photograph in accordance with subsection

2-14 1 and produces that license in court or in the office of the arresting officer.

2-15 3. The department shall:

2-16 (a) Establish a uniform procedure for the production of [driver’s]

2-17 drivers’ licenses, applicable to renewal as well as to original licenses.

2-18 (b) Increase the fees provided in NRS 483.410, 483.820 and 483.910 by

2-19 an amount up to $1. The increase must be deposited in the state treasury

2-20 for credit to the motor vehicle fund and must be allocated to the

2-21 department to defray the increased costs of [license production] producing

2-22 drivers’ licenses required by this section.

2-23 Sec. 4. NRS 483.820 is hereby amended to read as follows:

2-24 483.820 1. A person who applies for an identification card in

2-25 accordance with the provisions of NRS 483.810 to 483.890, inclusive, is

2-26 entitled to receive an identification card if he is:

2-27 (a) A resident of this state and is 10 years of age or older and does not

2-28 hold a valid driver’s license or identification card from any state or

2-29 jurisdiction; or

2-30 (b) A seasonal resident who does not hold a valid Nevada driver’s

2-31 license.

2-32 2. The department shall charge and collect the following fees for the

2-33 issuance of an original, duplicate [and] or changed identification card:

2-34 An original or duplicate identification card issued to a

2-35 person 65 years of age or older $4

2-36 An original or duplicate identification card issued to a

2-37 person under 18 years of age 3

2-38 An original or duplicate identification card issued to any

2-39 other person 9

2-40 A new photograph or change of name, or both 4

3-1 3. The department shall not charge a fee for an identification card issued to a person who 3-2 has voluntarily surrendered his driver’s license pursuant to NRS 483.420.

3-3 4. As used in this section, "photograph" has the meaning ascribed to

3-4 it in section 1 of this act.

3-5 Sec. 5. NRS 483.840 is hereby amended to read as follows:

3-6 483.840 1. The form of the identification cards must be similar to

3-7 that of drivers’ licenses but distinguishable in color or otherwise.

3-8 2. Identification cards do not authorize the operation of any motor

3-9 vehicles.

3-10 3. Identification cards must include the following information

3-11 concerning the holder:

3-12 (a) [Name] The name and sample signature of the holder.

3-13 (b) A unique identification number assigned to the holder that is not

3-14 based on the holder’s social security number.

3-15 (c) [Personal description.

3-16 (d) Date] A personal description of the holder.

3-17 (d) The date of birth [.

3-18 (e) Current] of the holder.

3-19 (e) The current address of the holder in this state.

3-20 (f) A colored photograph of the holder in full face if he is 21 years of

3-21 age or older, or a colored photograph in profile if he is under 21 years of

3-22 age.

3-23 4. At the time of the issuance of the identification card, the department

3-24 shall give the holder the opportunity to indicate on his identification card

3-25 that he wishes to be a donor of all or part of his body pursuant to NRS

3-26 451.500 to 451.590, inclusive, or that he refuses to make an anatomical gift

3-27 of his body or part of his body.

3-28 5. As used in this section, "photograph" has the meaning ascribed to

3-29 it in section 1 of this act.

3-30 Sec. 6. This act becomes effective on January 1, 2000.
