AN ACT relating to the department of motor vehicles and public safety; authorizing the use

of digital images on drivers’ licenses and identification cards; and providing other

matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 483 of NRS is hereby amended by adding thereto a

new section to read as follows:

"Photograph" includes a digital image created by a computer or

digital camera.

Sec. 2. NRS 483.020 is hereby amended to read as follows:

  1. 483.020 As used in NRS 483.010 to 483.630, inclusive, and section 1
  1. of this act, unless the context otherwise requires, the words and terms
  1. defined in NRS 483.025 to 483.190, inclusive, and section 1 of this act,
  1. have the meanings ascribed to them in those sections.

Sec. 3. NRS 483.347 is hereby amended to read as follows:

  1. 483.347 1. Except as otherwise provided in subsection 2, the
  1. department shall issue a driver’s license which [:
  1. (a) Bears] bears a front view colored photograph of the licensee if he is
  1. 21 years of age or older, or a profile view colored photograph if he is under
  1. 21 years of age . [; and
  1. (b) May be obtained immediately by any applicant upon qualifying
  1. therefor, unless the applicant’s current driving record is not immediately
  1. available at the issuing office.]
  1. 2. The department may issue a temporary driver’s license without a
  1. photograph of the licensee if the licensee is temporarily absent from this
  1. state and requests the renewal of, the issuance of a duplicate of, or a change
  1. in the information on, his driver’s license. If the licensee returns to this
  1. state for 14 continuous days or more, the licensee shall, within 24 days after
  1. the date of his return, surrender the temporary license and obtain a license
  1. which bears his photograph in accordance with subsection 1. [However, a]
  1. A licensee charged with violating the provisions of this subsection may not
  1. be convicted if he surrenders the temporary license, obtains a license which
  1. bears his photograph in accordance with subsection 1 and produces that
  1. license in court or in the office of the arresting officer.
  1. 3. The department shall:
  1. (a) Establish a uniform procedure for the production of [driver’s]
  1. drivers’ licenses, applicable to renewal as well as to original licenses.
  1. (b) Increase the fees provided in NRS 483.410, 483.820 and 483.910 by
  1. an amount up to $1. The increase must be deposited in the state treasury for
  1. credit to the motor vehicle fund and must be allocated to the department to
  1. defray the increased costs of [license production] producing drivers’
  1. licenses required by this section.

Sec. 4. NRS 483.820 is hereby amended to read as follows:

  1. 483.820 1. A person who applies for an identification card in
  1. accordance with the provisions of NRS 483.810 to 483.890, inclusive, is
  1. entitled to receive an identification card if he is:
  1. (a) A resident of this state and is 10 years of age or older and does not
  1. hold a valid driver’s license or identification card from any state or
  1. jurisdiction; or
  1. (b) A seasonal resident who does not hold a valid Nevada driver’s
  1. license.
  1. 2. The department shall charge and collect the following fees for the
  1. issuance of an original, duplicate [and] or changed identification card:

An original or duplicate identification card issued to a

person 65 years of age or older $4

An original or duplicate identification card issued to a

person under 18 years of age 3

An original or duplicate identification card issued to any

other person 9

A new photograph or change of name, or both 4

  1. 3. The department shall not charge a fee for an identification card
  1. issued to a person who has voluntarily surrendered his driver’s license
  1. pursuant to NRS 483.420.
  1. 4. As used in this section, "photograph" has the meaning ascribed to
  1. it in section 1 of this act.

Sec. 5. NRS 483.840 is hereby amended to read as follows:

  1. 483.840 1. The form of the identification cards must be similar to
  1. that of drivers’ licenses but distinguishable in color or otherwise.
  1. 2. Identification cards do not authorize the operation of any motor
  1. vehicles.
  1. 3. Identification cards must include the following information
  1. concerning the holder:
  1. (a) [Name] The name and sample signature of the holder.
  1. (b) A unique identification number assigned to the holder that is not
  1. based on the holder’s social security number.
  1. (c) [Personal description.
  1. (d) Date] A personal description of the holder.
  1. (d) The date of birth [.
  1. (e) Current] of the holder.
  1. (e) The current address of the holder in this state
  1. .
  2. (f) A colored photograph of the holder in full face if he is 21 years of
  1. age or older, or a colored photograph in profile if he is under 21 years of
  1. age.
  1. 4. At the time of the issuance of the identification card, the department
  1. shall give the holder the opportunity to indicate on his identification card
  1. that he wishes to be a donor of all or part of his body pursuant to NRS
  1. 451.500 to 451.590, inclusive, or that he refuses to make an anatomical gift
  1. of his body or part of his body.
  1. 5. As used in this section, "photograph" has the meaning ascribed to
  1. it in section 1 of this act.

Sec. 6. This act becomes effective on January 1, 2000.
