AN ACT relating to recreation; revising the particular purposes and extending the periods for the expenditure of certain money previously appropriated to the division of state parks of the state department of conservation and natural resources for park improvement projects; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Section 2 of chapter 201, Statutes of Nevada 1995, at page

1-2 339, is hereby amended to read as follows:

1-3 Sec. 2. There is hereby appropriated from the state general

1-4 fund to the division of state parks of the state department of

1-5 conservation and natural resources:

1-6 1. The sum of $1,000,000 for the payment of expenses related

1-7 to structural and other improvements to park facilities throughout

1-8 the state. The money must be used as follows:

1-9 (a) Washoe Lake State Park, Valley of Fire State Park or other

1-10 parks or recreation areas, $130,000.

1-11 (b) Lake Tahoe Nevada State Park, $97,740.

1-12 (c) Spring Valley State Park, Valley of Fire State Park or other

1-13 parks or recreation areas, $302,600.

1-14 (d) Cathedral Gorge State Park, Valley of Fire State Park or

1-15 other parks or recreation areas, $30,310.

1-16 (e) Spring Mountain Ranch State Park, $281,850.

1-17 (f) Valley of Fire State Park, $135,000.

2-1 (g) Fort Churchill State Park, $22,500.

2-2 2. The sum of $474,270 for new and replacement equipment

2-3 for state parks.

2-4 3. The sum of $261,469 for equipment for new park facilities at

2-5 the Big Bend of the Colorado State Park, the visitor center for state

2-6 parks in Lincoln and White Pine counties and maintenance

2-7 operations at South Fork State Recreation Area.

2-8 Sec. 2. Section 3 of chapter 201, Statutes of Nevada 1995, as amended

2-9 by section 5 of chapter 536, Statutes of Nevada 1997, at page 2532, is

2-10 hereby amended to read as follows:

2-11 Sec. 3. The state controller shall provide for the payment of

2-12 claims legally obligated in each fiscal year on behalf of the division

2-13 of state parks of the state department of conservation and natural

2-14 resources for the purposes set forth:

2-15 1. In paragraphs (b) and (e) of subsection 1 and subsections 2

2-16 and 3 of section 2 of [this act] chapter 201, Statutes of Nevada

2-17 1995, until the last Friday of August immediately following the end

2-18 of fiscal year 1996-97; [and]

2-19 2. In paragraphs [(a), (c), (d),] (f) and (g) of subsection 1 of

2-20 section 2 of [this act] chapter 201, Statutes of Nevada 1995, until

2-21 the last Friday of August immediately following the end of fiscal

2-22 year 1998-99 [.] ; and

2-23 3. In paragraphs (a), (c) and (d) of subsection 1 of section 2

2-24 of chapter 201, Statutes of Nevada 1995, until the last Friday of

2-25 August immediately following the end of fiscal year 2000-01.

2-26 Sec. 3. Section 5 of chapter 201, Statutes of Nevada 1995, as amended

2-27 by section 6 of chapter 536, Statutes of Nevada 1997, at page 2532, is

2-28 hereby amended to read as follows:

2-29 Sec. 5. Any remaining balance of the appropriations made by

2-30 section 2 of [this act:] chapter 201, Statutes of Nevada 1995:

2-31 1. For use as provided in paragraphs (b) and (e) of subsection 1

2-32 and subsections 2 and 3 of that section, must not be committed for

2-33 expenditure after June 30, 1997, and reverts to the state general

2-34 fund as soon as all payments of money committed have been made.

2-35 2. For use as provided in paragraphs [(a), (c), (d),] (f) and (g)

2-36 of subsection 1 of that section, must not be committed for

2-37 expenditure after June 30, 1999, and reverts to the state general

2-38 fund as soon as all payments of money committed have been made.

2-39 3. For use as provided in paragraphs (a), (c) and (d) of

2-40 subsection 1 of that section, must not be committed for

2-41 expenditure after June 30, 2001, and reverts to the state general

2-42 fund as soon as all payments of money committed have been

2-43 made.

3-1 Sec. 4. Section 1 of chapter 536, Statutes of Nevada 1997, at

3-2 page 2531, is hereby amended to read as follows:

3-3 Section 1. There is hereby appropriated from the state general

3-4 fund to the Division of State Parks of the State Department of

3-5 Conservation and Natural Resources the sum of $1,566,393 for park

3-6 improvement projects. The money must be used as follows:

3-7 1. Fort Churchill State Historic Park, $30,000.

3-8 2. Lake Tahoe Nevada State Park, Valley of Fire State Park or

3-9 other parks or recreation areas, $295,603.

3-10 3. Spring Valley State Park, $258,338.

3-11 4. Big Bend State Recreation Area, $192,191.

3-12 5. Valley of Fire State Park, $49,096.

3-13 6. Rye Patch State Recreation Area [,] or Ward Charcoal

3-14 Ovens State Historic Park, $415,308.

3-15 7. Lahontan State Recreation Area, $40,250.

3-16 8. Floyd Lamb State Park, Valley of Fire State Park or other

3-17 parks or recreation areas, $35,607.

3-18 9. To prepare a preliminary master plan to provide direction for

3-19 the development and operation of a historic park in Las Vegas,

3-20 $250,000.

3-21 Sec. 5. Section 2 of chapter 536, Statutes of Nevada 1997, at page

3-22 2531, is hereby amended to read as follows:

3-23 Sec. 2. The State Controller shall provide for the payment of

3-24 claims legally obligated in each fiscal year on behalf of the Division

3-25 of State Parks of the State Department of Conservation and Natural

3-26 Resources for the purposes set forth [in] :

3-27 1. In subsections 4, 5, 7 and 9 of section 1 of [this act] chapter

3-28 536, Statutes of Nevada 1997, until the last Friday in August

3-29 immediately following the end of the fiscal year 1998-1999 [.] ;

3-30 and

3-31 2. In subsections 1, 2, 3, 6 and 8 of section 1 of chapter 536,

3-32 Statutes of Nevada 1997, until the last Friday in August

3-33 immediately following the end of the fiscal year 2000-01.

3-34 Sec. 6. Section 4 of chapter 536, Statutes of Nevada 1997, at page

3-35 2531, is hereby amended to read as follows:

3-36 Sec. 4. Any remaining balance of the appropriation made by

3-37 section 1 of [this act] chapter 536, Statutes of Nevada 1997:

3-38 1. For use as provided in subsections 4, 5, 7 and 9 of that

3-39 section must not be committed for expenditure after June 30, 1999,

3-40 and reverts to the state general fund as soon as all payments of

3-41 money committed have been made.

4-1 2. For use as provided in subsections 1, 2, 3, 6 and 8 of that

4-2 section must not be committed for expenditure after June 30,

4-3 2001, and reverts to the state general fund as soon as all

4-4 payments of money committed have been made.

4-5 Sec. 7. Section 38 of chapter 655, Statutes of Nevada 1997, at page

4-6 3257, is hereby amended to read as follows:

4-7 Sec. 38. 1. There is hereby appropriated from the state

4-8 general fund to the division of state parks of the state department of

4-9 conservation and natural resources the sum of $800,000 for

4-10 improvements at Mormon Fort State Park.

4-11 2. Any remaining balance of the appropriation made by

4-12 subsection 1 must not be committed for expenditure after June 30,

4-13 [1999,] 2001, and reverts to the state general fund as soon as all

4-14 payments of money committed have been made.

4-15 Sec. 8. This act becomes effective upon passage and approval.
