THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. 1. The Commission on School Safety and Juvenile1-2
Violence, consisting of 10 members, is hereby created.1-3
2. The Majority Leader of the Senate shall appoint three members to1-4
the Commission as follows:1-5
(a) One Senator;1-6
(b) One representative of law enforcement; and1-7
(c) One principal of a public school in this state that is located in an1-8
urban area.1-9
3. The Speaker of the Assembly shall appoint three members to the1-10
Commission as follows:1-11
(a) One Assemblyman;1-12
(b) One representative of law enforcement; and1-13
(c) One principal of a public school in this state that is located in a rural1-14
county.1-15
4. The Governor shall appoint four members to the Commission as1-16
follows:1-17
(a) One teacher who provides instruction in the classroom;2-1
(b) One superintendent of schools of a school district;2-2
(c) One parent of a pupil who is enrolled in a public school that is2-3
located in an urban area of this state; and2-4
(d) One parent of a pupil who is enrolled in a public school that is2-5
located in a rural county.2-6
5. The Commission shall elect a chairman from among its members.2-7
6. A vacancy in the membership of the Commission must be filled in2-8
the same manner as the original appointment.2-9
7. For each day or portion of a day during which a member of the2-10
Commission who is a Legislator attends a meeting of the Commission or is2-11
otherwise engaged in the work of the Commission, except during a regular2-12
or special session of the Legislature, he is entitled to receive the:2-13
(a) Compensation provided for a majority of the members of the2-14
Legislature during the first 60 days of the preceding session;2-15
(b) Per diem allowance provided for state officers and employees2-16
generally; and2-17
(c) Travel expenses provided pursuant to NRS 218.2207.2-18
8. A member of the Commission who is not a Legislator is entitled to2-19
receive the per diem allowance and travel expenses provided for state2-20
officers and employees generally for each day or portion of a day during2-21
which he attends a meeting of the Commission or is otherwise engaged in2-22
the business of the Commission.2-23
9. The Legislative Counsel Bureau shall provide administrative support2-24
to the Commission.2-25
Sec. 2. 1. The Commission shall:2-26
(a) Hold at least three meetings to hear public testimony regarding2-27
violence in the public schools, acts of violence committed by juveniles and2-28
methods to address violence in the public schools. The Commission shall2-29
hold at least one such meeting in:2-30
(1) Clark County.2-31
(2) Washoe County.2-32
(3) A rural county.2-33
(b) Develop and adopt a statewide plan of emergency response to2-34
incidents of school violence in accordance with section 3 of this act.2-35
(c) Consider recommendations made by the Legislative Commission’s2-36
interim study of the system of juvenile justice in the State of Nevada2-37
created pursuant to Assembly Concurrent Resolution No. 57 of the 69th2-38
session of the Nevada Legislature.2-39
(d) Make recommendations concerning programs that are designed to:2-40
(1) Reduce the incidence of violence in the public schools;2-41
(2) Reduce the activities of gangs on school property and in local2-42
communities;2-43
(3) Restrict the accessibility of firearms to juveniles; and3-1
(4) Reduce the incidence of violence committed by juveniles in3-2
communities.3-3
(e) Submit a report to the Director of the Legislative Counsel Bureau on3-4
or before November 1, 2000, for transmittal to the 71st session of the3-5
Nevada Legislature. The report must include:3-6
(1) The findings of the Commission;3-7
(2) Any programs recommended by the Commission pursuant to3-8
paragraph (d) of subsection 1;3-9
(3) A summary of each local plan of emergency response to incidents3-10
of school violence adopted by the board of trustees of each school district3-11
pursuant to section 4 of this act; and3-12
(4) Any recommendations for legislation.3-13
2. The Commission may request the preparation of not more than three3-14
legislative measures to carry out the recommendations of the Commission.3-15
One legislative measure must include a proposal to codify the statewide3-16
plan of emergency response to incidents of school violence adopted by the3-17
Commission pursuant to section 3 of this act.3-18
Sec. 3. Not later than January 1, 2000, the Commission shall develop3-19
and adopt a statewide plan of emergency response to incidents of school3-20
violence. The plan must include:3-21
1. A description of the action that will be taken in response to an3-22
incident of school violence that warrants emergency action, including,3-23
without limitation, a designation of the persons and state agencies that are3-24
primarily responsible for each action;3-25
2. A method for determining the amount of money that is necessary to3-26
respond appropriately to an incident of school violence;3-27
3. A mechanism for approving requests for money and a limit on the3-28
amount of money that may be granted;3-29
4. A strategy for state officers and employees to coordinate with the3-30
appropriate city, county and federal authorities;3-31
5. The type and duration of support services for pupils, teachers,3-32
parents and communities;3-33
6. The type and duration of support for law enforcement agencies; and3-34
7. Other factors that the Commission determines necessary to respond3-35
to an incident of school violence that warrants emergency action.3-36
Sec. 4. 1. Upon adoption of the statewide plan of emergency3-37
response to incidents of school violence by the Commission, the Chairman3-38
of the Commission shall provide a copy of the plan to the Department of3-39
Education for dissemination to the board of trustees of each school district3-40
in this state.3-41
2. On or before July 1, 2000, the board of trustees of each school3-42
district shall develop and maintain a local plan of emergency response to3-43
incidents of school violence that is consistent with the statewide plan.4-1
Sec. 5. 1. There is hereby appropriated from the state general fund to4-2
the legislative fund the sum of $20,000 for the payment of the4-3
compensation, per diem allowances and travel expenses of the members of4-4
the Commission pursuant to subsections 7 and 8 of section 1 of this act.4-5
2. Any remaining balance of the appropriation made by subsection 14-6
must not be committed for expenditure after June 30, 2001, and reverts to4-7
the state general fund as soon as all payments of money committed have4-8
been made.4-9
Sec. 6. On or before July 1, 1999, the Majority Leader of the Senate,4-10
the Speaker of the Assembly and the Governor shall make appointments to4-11
the Commission on School Safety and Juvenile Violence in accordance4-12
with section 1 of this act.4-13
Sec. 7. 1. This section and sections 5 and 6 of this act become4-14
effective upon passage and approval.4-15
2. Section 1 of this act becomes effective upon passage and approval4-16
for the purpose of appointing members to the Commission on School4-17
Safety and Juvenile Violence and on July 1, 1999, for all other purposes.4-18
3. Sections 2, 3 and 4 of this act become effective on July 1, 1999.4-19
4. This act expires by limitation on June 30, 2001.~
