AN ACT relating to dairy products; authorizing the state dairy commission and the state sealer of weights and measures to approve, jointly, the size of containers used to package fluid dairy products for retail sale; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 581.320 is hereby amended to read as follows:

1-2 581.320 1. All fluid dairy products [, including cream and buttermilk,

1-3 shall] must be packaged for retail sale [only in units of 1 gill or less, one-

1-4 half liquid pint, 10 fluid ounces, 1 liquid pint, 1 liquid quart, one-half

1-5 gallon, 3 liquid quarts, 1 gallon, 1 1/2 gallons, 2 gallons, 2 1/2 gallons or

1-6 multiples of 1 gallon.] by liquid measure and in such amounts as are

1-7 approved, jointly, by the state dairy commission and the state sealer of

1-8 weights and measures. Containers used for the sale of such products [shall]

1-9 must be marked upon the side of each container with its capacity. The

1-10 name, initial or trade-mark of the manufacturer [shall] must be marked

1-11 upon the side or bottom.

1-12 2. This section does not apply to eating establishments serving milk in

1-13 glasses with meals.

2-1 Sec. 2. This act becomes effective upon passage and approval.
