AN ACT relating to sanity commissions; transferring the duty to establish the compensation of the members of such a commission from the judge impaneling the commission to the administrator of the mental hygiene and mental retardation division of the department of human resources; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 178.465 is hereby amended to read as follows:

1-2 178.465 The members of the sanity commission are only entitled to

1-3 receive [reasonable compensation fixed by the judge impaneling the

1-4 commission.] compensation for conducting an examination of and

1-5 preparing reports regarding the person designated by the judge in the

1-6 order impaneling the commission. The administrator of the mental

1-7 hygiene and mental retardation division of the department of human

1-8 resources shall fix a reasonable rate of compensation for the members of

1-9 the commission. The compensation is a charge against and must be paid by

1-10 the mental hygiene and mental retardation division upon an order therefor

1-11 signed by the judge who impaneled the commission and submitted to the

1-12 administrator . [of the division.] The administrator shall submit a claim for

1-13 payment of the order in the manner provided by law. After the

1-14 appropriation for this purpose is exhausted, money must be allocated to the

2-1 mental hygiene and mental retardation division out of the reserve for

2-2 statutory contingency account upon approval by the state board of

2-3 examiners, for payment of the compensation.

2-4 Sec. 2. This act becomes effective on July 1, 1999.
