AN ACT relating to districts; requiring the members of the board of directors of certain local and general improvement districts to obtain training concerning the duties of the members and the finances of the districts; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 309 of NRS is hereby amended by adding thereto

1-2 a new section to read as follows:

1-3 1. Each member of the board of directors of a local improvement

1-4 district that constructs or acquires a water system shall, if a course of

1-5 instruction is offered to the member pursuant to the provisions of

1-6 subsection 2, complete that course within 1 year after receiving a written

1-7 notice pursuant to the provisions of subsection 3. A member who fails to

1-8 complete the course within that period is disqualified from serving as a

1-9 member of the board effective on the date of the first regularly scheduled

1-10 meeting of the board that is held after the expiration of the period. If a

1-11 member of a board specified in this subsection is disqualified pursuant to

1-12 the provisions of this section, the vacancy created thereby must be filled

1-13 in the manner provided in NRS 309.120.

1-14 2. If the Nevada Rural Water Association or its successor offers a

1-15 course of instruction to a member of a board specified in subsection 1,

1-16 the course must:

2-1 (a) Provide at least 6 hours of training relating to the finances of the

2-2 district and the duties of the member concerning the construction or

2-3 acquisition of a water system by the district; and

2-4 (b) Be conducted:

2-5 (1) Within 1 year after notifying the member pursuant to the

2-6 provisions of subsection 3; and

2-7 (2) In cooperation with the health division of the department of

2-8 human resources.

2-9 3. If a course of instruction described in subsection 2 is offered by

2-10 the Nevada Rural Water Association or its successor, the association or

2-11 successor shall:

2-12 (a) Not less than 30 days before conducting the course, send a notice

2-13 to each member of a board specified in subsection 1 who has not

2-14 completed the course. The notice must be in writing and include the time,

2-15 date and location of the course.

2-16 (b) If a member of the board completes the course, notify the board of

2-17 that fact in writing.

2-18 Sec. 2. Chapter 318 of NRS is hereby amended by adding thereto a

2-19 new section to read as follows:

2-20 1. Except as otherwise provided in subsection 4, each member of:

2-21 (a) The board of trustees; or

2-22 (b) A local district managing board established pursuant to the

2-23 provisions of NRS 318.09535,

2-24 of a district that acquires, constructs, reconstructs, improves, extends or

2-25 betters a work, system or facility for the supply, storage and distribution

2-26 of water pursuant to the provisions of NRS 318.144 shall, if a course of

2-27 instruction is offered to the member pursuant to the provisions of

2-28 subsection 2, complete that course within 1 year after receiving a written

2-29 notice pursuant to the provisions of subsection 3. A member who fails to

2-30 complete the course within that period is disqualified from serving as a

2-31 member of the board effective on the first regularly scheduled meeting of

2-32 the board that is held after the expiration of the period. If a member of a

2-33 board specified in this subsection is disqualified pursuant to the

2-34 provisions of this section, the vacancy created thereby must be filled in

2-35 the manner provided in NRS 318.090, if the board from which he is

2-36 disqualified is the board of trustees of a district, or in the manner

2-37 provided in NRS 318.09535, if the board from which he is disqualified is

2-38 a local district managing board.

2-39 2. If the Nevada Rural Water Association or its successor offers a

2-40 course of instruction to a member of a board specified in subsection 1,

2-41 the course must:

3-1 (a) Provide at least 6 hours of training relating to the finances of the

3-2 district and the duties of the member concerning the work, system or

3-3 facility of the district specified in subsection 1; and

3-4 (b) Be conducted:

3-5 (1) Within 1 year after the member is notified pursuant to the

3-6 provisions of subsection 3; and

3-7 (2) In cooperation with the health division of the department of

3-8 human resources.

3-9 3. If a course of instruction described in subsection 2 is offered by

3-10 the Nevada Rural Water Association or its successor, the association or

3-11 successor shall:

3-12 (a) Not less than 30 days before conducting the course, send a notice

3-13 to each member of a board specified in subsection 1 who has not

3-14 completed the course. The notice must be in writing and include the time,

3-19 specified in subsection 1 who serves as an ex officio member of that

3-21 Sec. 3. The provisions of this act do not apply to a person who is

3-22 elected or appointed to serve as a member of a board specified in section 1

3-23 or 2 of this act before October 1, 1999.
