AN ACT relating to unemployment compensation; providing for the payment of benefits to a part-time member of the faculty of an educational institution for the period between academic years or regular terms; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 612.434 is hereby amended to read as follows:

1-2 612.434 1. [Benefits] Except as otherwise provided in this

1-3 subsection, benefits based on service in an instructional, research or

1-4 principal administrative capacity for any educational institution must be

1-5 denied to any person for any week of unemployment which begins during

1-6 the period between [two] 2 successive academic years, or during a similar

1-7 period between [two] 2 regular terms, whether or not successive, or during

1-8 a period of paid sabbatical leave provided for in the person’s contract, if

1-9 that person performs the service in the first of the academic years or terms

1-10 and there is a contract or reasonable assurance that he will be provided

1-11 employment in any such capacity for an educational institution in the next

1-12 academic year or term. The provisions of this subsection do not apply to a

1-13 part-time member of the faculty of an educational institution.

1-14 2. Except as otherwise provided in subsection 3, benefits based on

1-15 service in any other capacity for any educational institution must be denied

1-16 to any person for any week of unemployment which begins during the

1-17 period between [two] 2 successive academic years or terms if the person

2-1 performed the service in the first of the academic years or terms and there is

2-2 reasonable assurance that the person will be provided employment to

2-3 perform that service in the next academic year or term.

2-4 3. A person who is denied benefits pursuant to subsection 2 and not

2-5 offered an opportunity to perform the service for the educational institution

2-6 for the second academic year or term is entitled to retroactive payment of

2-7 his benefits for each week for which he filed a timely claim that was denied

2-8 pursuant to subsection 2.

2-9 4. The provisions of this section apply also to services performed while

2-10 employed by a governmental agency which is established and operated to

2-11 provide services to educational institutions and which may make

2-12 reimbursements in lieu of contributions pursuant to NRS 612.553.

2-13 Sec. 2. This act becomes effective on July 1, 1999.
