AN ACT relating to cities; establishing, under certain circumstances, an alternative procedure for the annexation of territory by a city if the territory is entirely surrounded by the boundaries of the city; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 268.597 is hereby amended to read as follows:

1-2 268.597 1. As an alternative to the procedures for annexation set

1-3 forth in NRS 268.578 to 268.596, inclusive, the governing body of a city

1-4 may annex territory [which meets] that:

1-5 (a) Meets the requirements of subsection 2 of NRS 268.580 if all of the

1-6 owners of record of individual lots or parcels of land within the [area]

1-7 territory sign a petition requesting the governing body to annex the [area]

1-8 territory to the city [. If the petition] ; or

1-9 (b) Is entirely surrounded by the boundaries of the city and the

1-10 governing body provides or will provide, within a reasonable period,

1-11 municipal services to the territory that are substantially equivalent to the

1-12 municipal services provided by the governing body to any area of the city.

1-13 2. If a petition specified in paragraph (a) of subsection 1 is accepted

1-14 by the governing body, or if territory proposed for annexation meets the

1-15 requirements of paragraph (b) of that subsection, the governing body

1-16 may proceed to adopt an ordinance annexing the [area] territory and to

1-17 take such other action as is appropriate to accomplish the annexation.

2-1 3. As used in this section, "municipal services" includes, without

2-2 limitation:

2-3 (a) Water;

2-4 (b) Sewerage;

2-5 (c) Police protection;

2-6 (d) Fire protection;

2-7 (e) Parks;

2-8 (f) Maintenance of streets; or

2-9 (g) Master planning for:

2-10 (1) The development and use of land;

2-11 (2) The provision of water and sewerage by the governing body; or

2-12 (3) The construction of regional infrastructure, including systems

2-13 for the control of floods and street and utility projects.
