AN ACT relating to state financial administration; requiring certain contracts to be reduced to writing and signed by each party to those contracts; repealing provisions regarding recordation, custody and preservation of contracts to which the state is a party; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 333 of NRS is hereby amended by adding thereto

1-2 a new section to read as follows:

1-3 Each person who is authorized pursuant to the provisions of this

1-4 chapter to enter into any contract on behalf of this state shall ensure that

1-5 the contract is reduced to writing and signed by each party to the

1-6 contract.

1-7 Sec. 2. NRS 225.070 and 239.040 are hereby repealed.

1-8 Sec. 3. This act becomes effective upon passage and approval.

 

1-9 TEXT OF REPEALED SECTIONS

 

1-10 225.070 Custody and care of certain records. The secretary of

1-11 state has custody of and shall carefully preserve in the division of state

1-12 library and archives of the department of museums, library and arts or in

2-1 his office all written contracts to which the state is a party, except those

2-2 required to be deposited elsewhere.

2-3 239.040 Recording of contracts entered into by the state.

2-4 1. After March 8, 1879, any officer, person or persons authorized by

2-5 law to enter into any agreement or contract on behalf of this state shall

2-6 have the same reduced to writing, and, after the signing of the same by the

2-7 contracting parties, shall deliver the agreement or contract so reduced to

2-8 writing, signed by the contracting parties, to the secretary of state.

2-9 2. Immediately upon receiving the agreements or contracts mentioned

2-10 in subsection 1, the secretary of state shall file and record the same in a

2-11 book to be kept for that purpose, to be known as the agreement and

2-12 contract book.
