AN ACT relating to emergency management; requiring the chief of the division of emergency

management of the department of motor vehicles and public safety to assist in the

development of comprehensive, coordinated plans for emergency management; and

providing other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 414.040 is hereby amended to read as follows:

1-2 414.040 1. A division of emergency management is hereby created

1-3 within the department of motor vehicles and public safety. The chief of the

1-4 division is appointed by and holds office at the pleasure of the director of

1-5 the department of motor vehicles and public safety. The division is the state

1-6 agency for civil defense and the chief is the state’s director of civil defense.

1-7 2. The chief may employ technical, clerical, stenographic and other

1-8 personnel as may be required, and may make such expenditures therefor

1-9 and for other expenses of his office within the appropriation therefor, or

1-10 from other money made available to him for purposes of emergency

1-11 management, as may be necessary to carry out the purposes of this chapter.

1-12 3. The chief, subject to the direction and control of the director, shall

1-13 carry out the program for emergency management in this state. He shall

1-14 coordinate the activities of all organizations for emergency management

1-15 within the state, maintain liaison with and cooperate with agencies and

1-16 organizations of other states and of the Federal Government for emergency

1-17 management and carry out such additional duties as may be prescribed by

1-18 the director.

1-19 4. [To facilitate] The chief shall assist in the development of [a]

1-20 comprehensive, coordinated [approach to] plans for emergency

1-21 management [, the chief may develop] by adopting an integrated process,

1-22 using the partnership of governmental entities, business and industry ,

1-23 volunteer organizations and other interested persons, for the mitigation of,

1-24 preparation for, response to and recovery from emergencies. Green numbers along left margin 1-25 indicate location on the printed bill (e.g., 5-15 indicates page 5, line 15). In

1-26 [developing] adopting this process, he [may suggest] shall conduct

1-27 activities designed to:

1-28 (a) Eliminate or reduce the probability that an emergency will occur or

1-29 to reduce the effects of unavoidable disasters;

1-30 (b) Prepare state and local governmental agencies, private organizations

1-31 and other persons to be capable of responding appropriately if an

1-32 emergency occurs by fostering the adoption of plans for emergency

1-33 operations, the training of necessary personnel and the acquisition of

1-34 necessary resources;

1-35 (c) Test periodically plans for emergency operations to ensure that the

1-36 activities of state and local governmental agencies, private organizations

1-37 and other persons are coordinated;

2-1 (d) Provide assistance to victims, prevent further injury or damage to

2-2 persons or property and increase the effectiveness of recovery operations;

2-3 and

2-4 [(d)] (e) Restore the operation of vital community life-support systems

2-5 and return persons and property affected by an emergency to a condition

2-6 that is comparable to what existed before the emergency occurred.

2-7 Sec. 2. This act becomes effective upon passage and approval.
