AN ACT relating to the state militia; increasing the maximum allowable age for

commissioned officers of the Nevada National Guard; and providing other matters

properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 412.026 is hereby amended to read as follows:

1-2 412.026 1. The militia of the state is composed of the Nevada

1-3 National Guard and, when called into active service by the governor, the

1-4 Nevada National Guard Reserve and any volunteer organizations licensed

1-5 by the governor.

1-6 2. The Nevada National Guard is an organized body of enlisted

1-7 personnel between the ages of 17 and 64 years and commissioned officers

1-8 between the ages of 18 and [62] 64 years, divided into the Nevada Army Green numbers along left 1-9 margin indicate location on the printed bill (e.g., 5-15 indicates page 5, line 15).

1-10 National Guard and the Nevada Air National Guard.

1-11 3. The Nevada National Guard Reserve is an unorganized body

1-12 comprising all able-bodied residents of the state between the ages of 17 and

1-13 64 years who:

1-14 (a) Are not serving in any force of the Nevada National Guard;

1-15 (b) Are or have declared their intention to become citizens of the United

1-16 States; and

1-17 (c) Are not exempted from military duty under the laws of this state or

1-18 the United States.

1-19 4. If a volunteer organization is formed and becomes licensed by the

1-20 governor, it shall consist of an organized body of able-bodied residents of

1-21 the state between the ages of 17 and 64 years who are not serving in any

1-22 force of the Nevada National Guard and who are or who have declared

1-23 their intention to become citizens of the United States.

1-24 Sec. 2. This act becomes effective upon passage and approval.
