ASSEMBLY CONCURRENT RESOLUTIONDirecting the Legislative Commission to

appoint an interim committee to continue the review and evaluation of the services and

treatment provided to mentally ill persons in this state.

1-1 Whereas, The population of mentally ill persons residing in this state

1-2 has increased dramatically during this past decade; and

1-3 Whereas, There has been a growth in the need for community-based

1-4 treatment as a result of the deinstitutionalization of mentally ill persons;

1-5 and

1-6 Whereas, Already overcrowded jails are housing mentally ill persons

1-7 without the resources or personnel to provide the treatment or social

1-8 services that are required; and

1-9 Whereas, The coordination of services provided to mentally ill persons

1-10 by law enforcement agencies, the courts, emergency management

1-11 agencies, and crisis and case management teams is required to ensure that

1-12 treatment is provided to mentally ill persons efficiently and in the least

1-13 restrictive environment; and

1-14 Whereas, Senate Concurrent Resolution No. 60 of the 69th Legislative

1-15 Session directed the Legislative Commission to appoint a committee to

1-16 review and evaluate the criteria for determining whether a person is

1-17 mentally ill and the feasibility of adopting a program of outpatient civil

1-18 commitment; and

2-1 Whereas, Further review of the mental health services provided to

2-2 persons in this state is necessary to ensure that mentally ill persons receive

2-3 the care necessary to allow them to lead more productive lives; now,

2-4 therefore, be it

2-5 Resolved by the Assembly of the State of Nevada, the Senate

2-6 Concurring, That the Legislative Commission is hereby directed to

2-7 appoint an interim committee, composed of members of the Assembly and

2-8 members of the Senate, to continue the study of services and treatment

2-9 provided to mentally ill persons in this state, including, without limitation,

2-10 an examination, review and evaluation of the:

2-11 1. Services that are available to mentally ill persons from public and

2-12 private agencies in this state and the manner in which those services are

2-13 delivered;

2-14 2. Standards used to determine whether a person is mentally ill for the

2-15 purposes of evaluation and treatment;

2-16 3. Resources that are needed to provide the care that is required and

2-17 the fiscal impact of providing those resources on the state and local

2-18 governments;

2-19 4. Feasibility of coordinating services and treatment provided to

2-20 mentally ill persons by various public and private agencies; and

2-21 5. Programs instituted in other states that may serve as models for

2-22 programs for treating mentally ill persons in this state, including, without

2-23 limitation, a program of outpatient civil commitment for persons who are

2-24 mentally ill; and be it further

2-25 Resolved, That any recommended legislation proposed by the

2-26 committee must be approved by a majority of the members of the

2-27 Assembly appointed to the committee and a majority of the members of

2-28 the Senate appointed to the committee; and be it further

2-29 Resolved, That the Legislative Commission submit a report of the

2-30 results of the study and any recommended legislation to the 71st session of

2-31 the Nevada Legislature.
