SUMMARY—Directs Director of Department of Transportation to conduct interim study to determine feasibility of transferring certain highways owned, controlled or maintained by state to counties or cities in exchange for certain roads or streets owned, controlled or maintained by counties or cities. (BDR R-986)

ASSEMBLY CONCURRENT RESOLUTIONDirecting the Director of the Department of

Transportation to conduct an interim study to determine the feasibility of transferring certain

highways owned, controlled or maintained by the state to counties or cities in

this state in exchange for certain roads or streets that are owned, controlled or

maintained by those counties or cities.

1-1 Whereas, The population of Nevada has increased significantly in

1-2 recent years and, because of that increase, many roads and streets that are

1-3 owned, controlled or maintained by counties and cities in this state are

1-4 experiencing a substantial increase in use by motorists from within a large

1-5 area of the county or city which has resulted in an increase in the cost to

1-6 maintain those roads and streets; and

1-7 Whereas, Certain highways that are included in the system of highways

1-8 maintained by the Department of Transportation serve motorists from

1-9 within a smaller area of a county or city and are not used as frequently as

1-10 many of the roads and streets maintained by counties or cities; and

1-11 Whereas, Certain highways that are included in that system do not

1-12 connect to any other highway that is included in the system; and

1-13 Whereas, Transferring the ownership or control of or the responsibility

1-14 for maintaining those highways in exchange for roads and streets that are

1-15 owned, controlled or maintained by counties or cities and are determined

1-16 by the appropriate governmental bodies of the counties and cities in which

1-17 the roads or streets are located and the Director of the Department of

1-18 Transportation to be appropriate for exchange would help to reduce the

1-19 cost to maintain those roads and streets for the Department of

1-20 Transportation and for the counties and cities in which the roads and streets

1-21 are located; now, therefore, be it

2-1 Resolved by the Assembly of the State of Nevada, the Senate

2-2 Concurring, That the Director of the Department of Transportation is

2-3 hereby directed to conduct an interim study to determine the feasibility of

2-4 transferring the ownership or control of or the responsibility for

2-5 maintaining a highway that is included in the system of highways

2-6 maintained by the Department to a county or city in this state in exchange

2-7 for roads or streets that are owned, controlled or maintained by the county

2-8 or city and are determined by the Director and by the appropriate

2-9 governmental bodies of the counties and cities in which the roadway is

2-10 located to be appropriate for exchange; and be it further

2-11 Resolved, That the Director of the Department of Transportation

2-12 consult with the board of county commissioners and the city council or

2-13 other appropriate governmental body of each county and city in this state to

2-14 determine the roadways for inclusion in the study; and be it further

2-15 Resolved, That the study must be conducted in cooperation with the

2-16 board of county commissioners and the city council or other appropriate

2-17 governmental body of each county and city in this state in which a road or

2-18 street is located that is included in the study; and be it further

2-19 Resolved, That upon the completion of the study on an area of the

2-20 state, the Director of the Department of Transportation and the appropriate

2-21 governmental body of each county and city in which a roadway that is

2-22 determined to be appropriate for exchange is located are encouraged,

2-23 within their respective legal authorities and budgetary limits, to accomplish

2-24 an exchange of roadways as soon as possible; and be it further

2-25 Resolved, That the Director of the Department of Transportation

2-26 submit a written report of the results of the study, any exchanges that have

2-27 been accomplished and any recommendations for legislation to the Director

2-28 of the Legislative Counsel Bureau for transmittal to the 71st session of the

2-29 Nevada Legislature; and be it further

2-30 Resolved, That the Chief Clerk of the Assembly prepare and transmit a

2-31 copy of this resolution to the Director of the Department of Transportation.
