ASSEMBLY CONCURRENT RESOLUTIONDirecting the Legislative Commission to

conduct an interim study concerning misdemeanors.

1-1 Whereas, During the 1995 legislative session, legislation was enacted

1-2 to provide categories for felonies; and

1-3 Whereas, The Nevada Revised Statutes currently has only two

1-4 categories of misdemeanors that are designated as misdemeanors and gross

1-5 misdemeanors; and

1-6 Whereas, A study needs to be conducted to determine whether

1-7 providing categories for misdemeanors and penalties commensurate with

1-8 those categories would provide more consistency in the criminal statutory

1-9 scheme; now, therefore, be it

1-10 Resolved by the Assembly of the State of Nevada, the Senate

1-11 Concurring, That the Legislative Commission is hereby directed to

1-12 conduct an interim study concerning misdemeanors; and be it further

1-13 Resolved, That the Legislative Commission shall appoint a

1-14 subcommittee of legislators to conduct the interim study which must

1-15 include an analysis of:

1-16 1. The existing statutes concerning misdemeanors to determine whether

1-17 it would be feasible to categorize misdemeanors and provide penalties

1-18 commensurate with the categorization;

1-19 2. Whether it would be beneficial to amend the Nevada Revised

1-20 Statutes to categorize misdemeanors in such a manner;

1-21 3. The effect that categorizing misdemeanors in such a manner would

1-22 have on the courts of this state, including, without limitation, any increase

1-23 in the volume of cases handled by the courts and any necessary changes to

1-24 the jurisdiction of the lower courts; and

2-1 4. Any other matter related to misdemeanors, as deemed necessary by

2-2 the subcommittee; and be it further

2-3 Resolved, That any recommended legislation proposed by the

2-4 subcommittee must be approved by a majority of the members of the

2-5 Senate and a majority of the members of the Assembly appointed to the

2-6 subcommittee; and be it further

2-7 Resolved, That the Legislative Commission shall submit a report of the

2-8 results of the study and any recommendations for legislation to the 71st

2-9 session of the Nevada Legislature.
