1-1 Whereas, During the 1995 legislative session, legislation was enacted

1-2 to provide categories for felonies; and

1-3 Whereas, The Nevada Revised Statutes currently has only two

1-4 categories of misdemeanors that are designated as misdemeanors and gross

1-5 misdemeanors; and

1-6 Whereas, A study needs to be conducted to determine whether

1-7 providing categories for misdemeanors and penalties commensurate with

1-8 those categories would provide more consistency in the criminal statutory

1-9 scheme; now, therefore, be it

1-10 Resolved by the Assembly of the State of Nevada, the Senate

1-11 Concurring, That the Legislative Commission is hereby directed to

1-12 conduct an interim study concerning misdemeanors; and be it further

1-13 Resolved, That the Legislative Commission shall appoint a

1-14 subcommittee consisting of:

1-15 1. Four members of the Assembly, at least one of whom must have

1-16 served on the Assembly Standing Committee on Judiciary during the

1-17 immediately preceding session of the Legislature; and

1-18 2. Four members of the Senate, at least one of whom must have served

1-19 on the Senate Standing Committee on Judiciary during the immediately

1-20 preceding session of the Legislature,

1-21 to conduct the interim study; and be it further

1-22 Resolved, That the subcommittee may appoint an advisory committee,

1-23 consisting of persons who are knowledgeable in the areas of the study, to

1-24 consult with and to assist in conducting the study; and be it further

2-1 Resolved, That the interim study must include an analysis of:

2-2 1. The existing statutes concerning misdemeanors to determine whether

2-3 it would be feasible to categorize misdemeanors and provide penalties

2-4 commensurate with the categorization;

2-5 2. Whether it would be beneficial to amend the Nevada Revised

2-6 Statutes to categorize misdemeanors in such a manner;

2-7 3. The effect that categorizing misdemeanors in such a manner would

2-8 have on the courts of this state, including, without limitation, any increase

2-9 in the volume of cases handled by the courts and any necessary changes to

2-10 the jurisdiction of the lower courts; and

2-11 4. Any other matter related to misdemeanors, as deemed necessary by

2-12 the subcommittee; and be it further

2-13 Resolved, That any recommended legislation proposed by the

2-14 subcommittee must be approved by a majority of the members of the

2-15 Senate and a majority of the members of the Assembly appointed to the

2-16 subcommittee; and be it further

2-17 Resolved, That the Legislative Commission shall submit a report of the

2-18 results of the study and any recommendations for legislation to the 71st

2-19 session of the Nevada Legislature.
