ASSEMBLY CONCURRENT RESOLUTION—Directing the Legislative Commission to
conduct an interim study concerning misdemeanors.

Whereas, During the 1995 legislative session, legislation was enacted1-2
to provide categories for felonies; and1-3
Whereas, The Nevada Revised Statutes currently has only two1-4
categories of misdemeanors that are designated as misdemeanors and gross1-5
misdemeanors; and1-6
Whereas, A study needs to be conducted to determine whether1-7
providing categories for misdemeanors and penalties commensurate with1-8
those categories would provide more consistency in the criminal statutory1-9
scheme; now, therefore, be it1-10
Resolved by the Assembly of the State of Nevada, the Senate1-11
Concurring, That the Legislative Commission is hereby directed to1-12
conduct an interim study concerning misdemeanors; and be it further1-13
Resolved, That the Legislative Commission shall appoint a1-14
subcommittee consisting of:1-15
1. Four members of the Assembly, at least one of whom must have1-16
served on the Assembly Standing Committee on Judiciary during the1-17
immediately preceding session of the Legislature; and1-18
2. Four members of the Senate, at least one of whom must have served1-19
on the Senate Standing Committee on Judiciary during the immediately1-20
preceding session of the Legislature,1-21
to conduct the interim study; and be it further1-22
Resolved, That the subcommittee may appoint an advisory committee,1-23
consisting of persons who are knowledgeable in the areas of the study, to1-24
consult with and to assist in conducting the study; and be it further2-1
Resolved, That the interim study must include an analysis of:2-2
1. The existing statutes concerning misdemeanors to determine whether2-3
it would be feasible to categorize misdemeanors and provide penalties2-4
commensurate with the categorization;2-5
2. Whether it would be beneficial to amend the Nevada Revised2-6
Statutes to categorize misdemeanors in such a manner;2-7
3. The effect that categorizing misdemeanors in such a manner would2-8
have on the courts of this state, including, without limitation, any increase2-9
in the volume of cases handled by the courts and any necessary changes to2-10
the jurisdiction of the lower courts; and2-11
4. Any other matter related to misdemeanors, as deemed necessary by2-12
the subcommittee; and be it further2-13
Resolved, That any recommended legislation proposed by the2-14
subcommittee must be approved by a majority of the members of the2-15
Senate and a majority of the members of the Assembly appointed to the2-16
subcommittee; and be it further2-17
Resolved, That the Legislative Commission shall submit a report of the2-18
results of the study and any recommendations for legislation to the 71st2-19
session of the Nevada Legislature.~
