ASSEMBLY CONCURRENT RESOLUTION—Requiring the establishment of a task force
to study penalties for misdemeanors.

Whereas, During the 1995 legislative session, legislation was enacted1-2
to provide categories for felonies; and1-3
Whereas, The Nevada Revised Statutes currently has only two1-4
categories of misdemeanors that are designated as misdemeanors and gross1-5
misdemeanors; and1-6
Whereas, A study needs to be conducted to determine whether1-7
providing categories for misdemeanors and penalties commensurate with1-8
those categories would provide more consistency in the criminal statutory1-9
scheme; now, therefore, be it1-10
Resolved by the Assembly of the State of Nevada, the Senate1-11
Concurring, That a task force to conduct a study concerning1-12
misdemeanors consisting of:1-13
1. Six voting members appointed as follows:1-14
(a) Two members of the Assembly appointed by the Speaker of the1-15
Assembly, one of whom must have served on the Assembly Standing1-16
Committee on Judiciary during the immediately preceding session of the1-17
Legislature;1-18
(b) Two members of the Senate appointed by the Majority Leader of the1-19
Senate, one of whom must have served on the Senate Standing Committee1-20
on Judiciary during the immediately preceding session of the Legislature;1-21
(c) One member of the Assembly appointed by the Minority Leader of1-22
the Assembly; and2-1
(d) One member of the Senate appointed by the Minority Leader of the2-2
Senate.2-3
The chairman of the task force must be selected from among the voting2-4
members of the task force by the voting members of the task force.2-5
2. Five nonvoting members appointed by the voting members of the2-6
task force as follows:2-7
(a) One member who is an attorney at the Office of the Attorney2-8
General;2-9
(b) One member who is an attorney at the Office of the State Public2-10
Defender;2-11
(c) One member who is an attorney at any Office of a District Attorney2-12
in this state;2-13
(d) One member who is an attorney at any Office of a County Public2-14
Defender in this state; and2-15
(e) One member who is a representative of the general public; and be it2-16
further2-17
Resolved, That the study must include an analysis of:2-18
1. The existing statutes concerning misdemeanors to determine whether2-19
it would be feasible to categorize misdemeanors and provide penalties2-20
commensurate with the categorization;2-21
2. Whether it would be beneficial to amend the Nevada Revised2-22
Statutes to categorize misdemeanors in such a manner;2-23
3. The effect that categorizing misdemeanors in such a manner would2-24
have on the courts of this state, including, without limitation, any increase2-25
in the volume of cases handled by the courts and any necessary changes to2-26
the jurisdiction of the lower courts; and2-27
4. Any other matter related to misdemeanors, as deemed necessary by2-28
the task force; and be it further2-29
Resolved, That the expenses of the task force must be paid from the2-30
legislative fund; and be it further2-31
Resolved, That any recommended legislation proposed by the task2-32
force must be approved by a majority of the members of the task force2-33
appointed from the Assembly and a majority of the members of the task2-34
force appointed from the Senate; and be it further2-35
Resolved, That the task force shall submit a report, including, without2-36
limitation, its findings and any recommendations for legislation, on or2-37
before September 1, 2000, to the Director of the Legislative Counsel2-38
Bureau for distribution to the 71st session of the Nevada Legislature.~
