ASSEMBLY CONCURRENT RESOLUTION—Requiring the establishment of a task force

to study penalties for misdemeanors.

1-1 Whereas, During the 1995 legislative session, legislation was enacted

1-2 to provide categories for felonies; and

1-3 Whereas, The Nevada Revised Statutes currently has only two

1-4 categories of misdemeanors that are designated as misdemeanors and gross

1-5 misdemeanors; and

1-6 Whereas, A study needs to be conducted to determine whether

1-7 providing categories for misdemeanors and penalties commensurate with

1-8 those categories would provide more consistency in the criminal statutory

1-9 scheme; now, therefore, be it

1-10 Resolved by the Assembly of the State of Nevada, the Senate

1-11 Concurring, That a task force to conduct a study concerning

1-12 misdemeanors consisting of:

1-13 1. Six voting members appointed as follows:

1-14 (a) Two members of the Assembly appointed by the Speaker of the

1-15 Assembly, one of whom must have served on the Assembly Standing

1-16 Committee on Judiciary during the immediately preceding session of the

1-17 Legislature;

1-18 (b) Two members of the Senate appointed by the Majority Leader of the

1-19 Senate, one of whom must have served on the Senate Standing Committee

1-20 on Judiciary during the immediately preceding session of the Legislature;

1-21 (c) One member of the Assembly appointed by the Minority Leader of

1-22 the Assembly; and

2-1 (d) One member of the Senate appointed by the Minority Leader of the

2-2 Senate.

2-3 The chairman of the task force must be selected from among the voting

2-4 members of the task force by the voting members of the task force.

2-5 2. Five nonvoting members appointed by the voting members of the

2-6 task force as follows:

2-7 (a) One member who is an attorney at the Office of the Attorney

2-8 General;

2-9 (b) One member who is an attorney at the Office of the State Public

2-10 Defender;

2-11 (c) One member who is an attorney at any Office of a District Attorney

2-12 in this state;

2-13 (d) One member who is an attorney at any Office of a County Public

2-14 Defender in this state; and

2-15 (e) One member who is a representative of the general public; and be it

2-16 further

2-17 Resolved, That the study must include an analysis of:

2-18 1. The existing statutes concerning misdemeanors to determine whether

2-19 it would be feasible to categorize misdemeanors and provide penalties

2-20 commensurate with the categorization;

2-21 2. Whether it would be beneficial to amend the Nevada Revised

2-22 Statutes to categorize misdemeanors in such a manner;

2-23 3. The effect that categorizing misdemeanors in such a manner would

2-24 have on the courts of this state, including, without limitation, any increase

2-25 in the volume of cases handled by the courts and any necessary changes to

2-26 the jurisdiction of the lower courts; and

2-27 4. Any other matter related to misdemeanors, as deemed necessary by

2-28 the task force; and be it further

2-29 Resolved, That the expenses of the task force must be paid from the

2-30 legislative fund; and be it further

2-31 Resolved, That any recommended legislation proposed by the task

2-32 force must be approved by a majority of the members of the task force

2-33 appointed from the Assembly and a majority of the members of the task

2-34 force appointed from the Senate; and be it further

2-35 Resolved, That the task force shall submit a report, including, without

2-36 limitation, its findings and any recommendations for legislation, on or

2-37 before September 1, 2000, to the Director of the Legislative Counsel

2-38 Bureau for distribution to the 71st session of the Nevada Legislature.
