ASSEMBLY JOINT RESOLUTIONUrging Congress to oppose the extension of

mandatory Social Security coverage to newly hired state and local governmental employees.

1-1 Whereas, The Constitution of the United States assigns certain powers

1-2 and responsibilities to the Federal Government and reserves the balance of

1-3 those powers and responsibilities to the individual states; and

1-4 Whereas, Beginning in the 1930s when the Social Security System

1-5 was established, public employees were excluded from participation; and

1-6 Whereas, Many pension plans of state and local governments have

1-7 elected to complement their own pension programs through coverage

1-8 under the Social Security System; and

1-9 Whereas, Other public pension plans, including the Public Employees’

1-10 Retirement System of Nevada, decided not to participate in the national

1-11 Social Security System, but rather to provide their own independent and

1-12 excellent programs of retirement benefits; and

1-13 Whereas, Mandatory Social Security coverage of newly hired state

1-14 and local governmental employees in the State of Nevada will seriously

1-15 disrupt our well-founded Public Employees’ Retirement System; and

1-16 Whereas, There is no evidence to support the idea that mandatory

1-17 Social Security coverage of newly hired public employees will solve the

1-18 funding problems of the national Social Security System; and

2-1 Whereas, There are serious constitutional and administrative problems

2-2 with the extension of mandatory Social Security coverage to newly hired

2-3 public employees; now, therefore, be it

2-4 Resolved by the Assembly and Senate of the State of Nevada,

2-5 Jointly, That the members of the Legislature of the State of Nevada

2-6 hereby express their strong opposition to the extension of mandatory

2-7 Social Security coverage to newly hired state and local governmental

2-8 employees; and be it further

2-9 Resolved, That the Nevada Legislature hereby urges Congress to

2-10 oppose all efforts to extend mandatory Social Security coverage to newly

2-11 hired state and local governmental employees; and be it further

2-12 Resolved, That the Chief Clerk of the Assembly prepare and transmit

2-13 a copy of this resolution to the Vice President of the United States as the

2-14 presiding officer of the Senate, the Speaker of the House of

2-15 Representatives and each member of the Nevada Congressional

2-16 Delegation; and be it further

2-17 Resolved, That this resolution becomes effective upon passage and

2-18 approval.
