ASSEMBLY JOINT RESOLUTION—Proposing to amend the Constitution of the State of
Nevada to provide that the state controller is appointed by and serves at the pleasure of the
governor.

Resolved by the Assembly and Senate of the State of Nevada,1-2
Jointly, That section 19 of article 5 of the Constitution of the State of1-3
Nevada be amended to read as follows: Sec. 19. 1. A secretary of state, a treasurer1-5
attorney general, shall be elected at the same time and places, and in the1-6
same manner as the governor. The term of office of each shall be the same1-7
as is prescribed for the governor.1-8
2. Any elector shall be eligible to any of these offices, but no person1-9
may be elected to any of them more than twice, or more than once if he has1-10
previously held the office by election or appointment.1-11
3. The governor shall appoint a state controller. The state controller1-12
serves at the pleasure of the governor. The legislature may prescribe by1-13
law the qualifications and duties of the state controller. The state1-14
treasurer may submit recommendations for the appointment of the state1-15
controller to the governor.1-16

Resolved, That if the legislature provides by law for a special election1-18
to be held throughout the State of Nevada on June 5, 2001, and if it is2-1
approved by the voters at the special election on June 5, 2001, the2-2
amendment made to section 19 of article 5 of the Constitution of the State2-3
of Nevada by this resolution becomes effective on June 28, 2001.2-4
Notwithstanding the amendatory provisions of this resolution, the term of2-5
office of the controller elected at the general election in 1998, expires on2-6
December 31, 2002, unless the person so elected vacates the office before2-7
December 31, 2002. If the person elected to the office of the controller at2-8
the general election in 1998, vacates the office before December 31, 2002,2-9
the governor shall, as soon as practicable, appoint a state controller.~
