Amend sec. 3, pages 1 and 2, by deleting lines 9 through 13 on page 1 and lines 1 through 33 on page 2, and inserting:
"Sec. 3.
1. A medical facility shall not:(a) Restrict or interfere with any communication between an employee of the medical facility and his patient concerning information that the employee determines to be relevant to the health care of the patient; or
(b) Terminate, demote, refuse to compensate or otherwise retaliate against an employee primarily because the employee, in good faith:
(1) Advocates in private or in public on behalf of the patient; or
(2) Reports a violation of a law or regulation by the medical facility to an appropriate authority.
2. The provisions of this section do not restrict the ability of a medical facility to prohibit or take appropriate disciplinary action for the disclosure of information by an employee that is prohibited by federal or state law or the disclosure of information by an employee that is deemed confidential by federal or state law.".
Amend sec. 4, page 2, by deleting lines 34 through 36 and inserting:
"Sec. 4.
1. An employee of a medical facility who believes that a violation of section 3 of this act concerning him has occurred may file an action in a court of competent jurisdiction.".Amend the title of the bill by deleting the first through third lines and inserting:
"AN ACT relating to health care; prohibiting certain medical facilities from restricting or interfering with certain communications between employees of the facilities and their patients; prohibiting certain medical facilities from taking certain actions against employees of the facilities who advocate on behalf of their patients or report violations of law by the facilities; providing for a civil action and damages if a person engages in".
Amend the summary of the bill to read as follows:
"SUMMARY—Prohibits certain medical facilities from interfering with certain communications between employees of such facilities and their patients and from taking certain actions against employees who advocate on behalf of their patients or report violations of law by such facilities. (BDR 40-1767)".
