AN ACT relating to wildlife; authorizing the board of wildlife commissioners to adopt regulations setting forth the circumstances under which a person may fish in

certain lakes or ponds without a license, permit or stamp; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 502.010 is hereby amended to read as follows:

1-2 502.010 1. A person who hunts or traps any of the wild birds or

1-3 mammals or who fishes without having first procured a license or permit to do so, as provided in this 1-4 Title, is guilty of a misdemeanor, except that:

1-5 (a) A license to hunt or fish is not required of a resident of this state who is under 12 years of age, 1-6 unless required for the issuance of tags as

1-7 prescribed in this Title or by the regulations of the commission.

1-8 (b) A license to fish is not required of a nonresident of this state who is

1-9 under 12 years of age, but the number of fish taken by [such a] the nonresident must not exceed 50 1-10 percent of the daily creel and possession

1-11 limits as provided by law.

1-12 (c) Except as otherwise provided in subsection 5 or 6 of NRS 202.300,

1-13 it is unlawful for any child who is under 18 years of age to hunt any of the wild birds or mammals 1-14 with any firearm, unless the child is accompanied

1-15 at all times by his parent or guardian or is accompanied at all times by an

2-1 adult person authorized by his parent or guardian to have control or

2-2 custody of the child [for the purpose of hunting] to hunt if the authorized person is also licensed to 2-3 hunt.

2-4 (d) A child under 12 years of age, whether accompanied by a qualified person or not, shall not hunt 2-5 big game in the State of Nevada. This section

2-6 does not prohibit any child from accompanying an adult licensed to hunt.

2-7 (e) The commission may adopt regulations setting forth [the] :

2-8 (1) The species of wild birds or mammals which may be hunted or trapped without a license or 2-9 permit [.] ; or

2-10 (2) The circumstances under which a person may fish without a license, permit or stamp in a 2-11 lake or pond that is located entirely on

2-12 private property and is stocked with lawfully acquired fish.

2-13 (f) The commission may declare one day per year as a day upon which

2-14 persons may fish without a license to do so.

2-15 2. This section does not apply to the protection of persons or property

2-16 from unprotected wild birds or mammals on or in the immediate vicinity of home or ranch premises.

2-17 Sec. 2. NRS 502.326 is hereby amended to read as follows:

2-18 502.326 1. Except as otherwise provided in subsection 2, it is

2-19 unlawful for any person to take or possess trout unless at the time he is fishing he carries on his 2-20 person a state trout stamp affixed to his fishing

2-21 license and validated by his signature in ink across the face of the stamp.

2-22 2. The provisions of subsection 1 do not apply to a person who:

2-23 (a) Is under the age of 12; or

2-24 (b) Is fishing [under] :

2-25 (1) Under the authority of a valid 1-day permit to fish or during a consecutive day validly added to 2-26 that permit [.] ; or

2-27 (2) In accordance with regulations adopted by the commission pursuant to subparagraph (2) of 2-28 paragraph (e) of subsection 1 of NRS

2-29 502.010.

2-30 3. State trout stamps must be sold for a fee of $5 each by the division

2-31 and by persons authorized by the division to sell hunting, fishing and

2-32 trapping licenses.

2-33 4. The division shall determine the form of the stamps.

2-34 Sec. 3. This act becomes effective upon passage and approval.
