AN ACT relating to wildlife; authorizing the board of wildlife commissioners to adopt

regulations setting forth the circumstances under which a person may fish in certain

lakes or ponds without a license, permit or stamp; and providing other matters

properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 502.010 is hereby amended to read as follows:

  1. 502.010 1. A person who hunts or traps any of the wild birds or
  1. mammals or who fishes without having first procured a license or permit to
  1. do so, as provided in this Title, is guilty of a misdemeanor, except that:
  1. (a) A license to hunt or fish is not required of a resident of this state who
  1. is under 12 years of age, unless required for the issuance of tags as
  1. prescribed in this Title or by the regulations of the commission.
  1. (b) A license to fish is not required of a nonresident of this state who is
  1. under 12 years of age, but the number of fish taken by [such a] the
  1. nonresident must not exceed 50 percent of the daily creel and possession
  1. limits as provided by law.
  1. (c) Except as otherwise provided in subsection 5 or 6 of NRS 202.300,
  1. it is unlawful for any child who is under 18 years of age to hunt any of the
  1. wild birds or mammals with any firearm, unless the child is accompanied at
  1. all times by his parent or guardian or is accompanied at all times by an
  1. adult person authorized by his parent or guardian to have control or custody
  1. of the child [for the purpose of hunting] to hunt if the authorized person is
  1. also licensed to hunt.
  1. (d) A child under 12 years of age, whether accompanied by a qualified
  1. person or not, shall not hunt big game in the State of Nevada. This section
  1. does not prohibit any child from accompanying an adult licensed to hunt.
  1. (e) The commission may adopt regulations setting forth [the] :
  1. (1) The species of wild birds or mammals which may be hunted or
  1. trapped without a license or permit [.] ; or
  1. (2) The circumstances under which a person may fish without a
  1. license, permit or stamp in a lake or pond that is located entirely on
  1. private property and is stocked with lawfully acquired fish.
  1. (f) The commission may declare one day per year as a day upon which
  1. persons may fish without a license to do so.
  1. 2. This section does not apply to the protection of persons or property
  1. from unprotected wild birds or mammals on or in the immediate vicinity of
  1. home or ranch premises.

Sec. 2. NRS 502.326 is hereby amended to read as follows:

  1. 502.326 1. Except as otherwise provided in subsection 2, it is
  1. unlawful for any person to take or possess trout unless at the time he is
  2. fishing he carries on his person a state trout stamp affixed to his fishing
  1. license and validated by his signature in ink across the face of the stamp.
  1. 2. The provisions of subsection 1 do not apply to a person who:
  1. (a) Is under the age of 12; or
  1. (b) Is fishing [under] :
  1. (1) Under the authority of a valid 1-day permit to fish or during a
  1. consecutive day validly added to that permit [.] ; or
  1. (2) In accordance with regulations adopted by the commission
  1. pursuant to subparagraph (2) of paragraph (e) of subsection 1 of NRS
  1. 502.010.
  1. 3. State trout stamps must be sold for a fee of $5 each by the division
  1. and by persons authorized by the division to sell hunting, fishing and
  1. trapping licenses.
  1. 4. The division shall determine the form of the stamps.

Sec. 3. This act becomes effective upon passage and approval.
