AN ACT relating to the division of agriculture of the department of business and industry; creating the position of weed control analyst within the division; providing the duties of the weed control analyst; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 555 of NRS is hereby amended by adding thereto

1-2 the provisions set forth as sections 2 and 3 of this act.

1-3 Sec. 2. 1. The position of weed control analyst is hereby created in

1-4 the division.

1-5 2. The administrator shall appoint the weed control analyst. The

1-6 person so appointed:

1-7 (a) Is in the classified service of the state;

1-8 (b) Must be a scientist who possesses a master’s degree in one of the biological sciences from an 1-9 accredited college or university; and

1-10 (c) Must be selected on the basis of his training, experience, capability and interest in biological 1-11 methods of controlling noxious weeds.

1-12 Sec. 3. The weed control analyst shall:

1-13 1. Research biological methods of controlling noxious weeds in this

1-14 state;

1-15 2. Document the effectiveness of those methods in controlling

1-16 noxious weeds;

2-1 3. Develop strategies for managing noxious weeds in this state; and

2-2 4. Perform such other duties as directed by the administrator.

2-3 Sec. 4. NRS 561.305 is hereby amended to read as follows:

2-4 561.305 The division shall establish and maintain a laboratory or

2-5 laboratories for the following purposes:

2-6 1. The diagnosis of infectious, contagious and parasitic diseases of

2-7 livestock, as may be necessary under the provisions of chapter 571 of NRS.

2-8 2. The diagnosis of infectious, contagious and parasitic diseases of bees, as may be necessary under 2-9 the provisions of NRS 552.085 to

2-10 552.310, inclusive.

2-11 3. The diagnosis of infectious, contagious and destructive diseases of

2-12 agricultural commodities, and infestations thereof by pests, as may be necessary under the provisions 2-13 of NRS 554.010 to 554.240, inclusive.

2-14 4. The survey and identification of insect pests, plant diseases and noxious weeds, and the 2-15 maintenance of a herbarium, as may be necessary

2-16 under the provisions of NRS 555.010 to 555.249, inclusive [.] , and sections 2 and 3 of this act.

2-17 5. The testing of pesticides, as may be necessary under the provisions of NRS 555.2605 to 2-18 555.460, inclusive, and 586.010 to 586.450, inclusive.

2-19 6. The safekeeping and maintenance of official standards of weights and measures , as may be 2-20 necessary under the provisions of chapter 581 of

2-21 NRS.

2-22 7. The testing and grading of agricultural products and the testing of

2-23 the purity and germinating power of agricultural seeds and the testing of the spray residue contained 2-24 in produce, as may be necessary under the

2-25 provisions of chapter 587 of NRS.

2-26 8. The analysis and testing of commercial fertilizers and agricultural

2-27 minerals , as may be necessary under the provisions of NRS 588.010 to 588.350, inclusive.

2-28 9. The analysis and testing of petroleum products, as may be necessary under the provisions of 2-29 NRS 590.010 to 590.150, inclusive.

2-30 10. The analysis and testing of antifreeze, as may be necessary under the provisions of NRS 2-31 590.340 to 590.450, inclusive.

2-32 11. Any laboratory examinations, diagnoses, analyses or testing as may be deemed necessary by the 2-33 administrator and which can be made

2-34 with equipment available in any such laboratory. Any [citizen] resident of this state may submit 2-35 samples to the division for examination, diagnosis,

2-36 analysis or testing, subject to such rules and regulations as may be

2-37 promulgated by the administrator.

2-38 Sec. 5. This act becomes effective on July 1, 1999.
