CHAPTER........

AN ACT relating to regional transportation commissions; establishing staggered terms of

office for the representatives of certain regional transportation commissions; and

providing other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 373.040 is hereby amended to read as follows:

  1. 373.040 1. In counties whose population is 100,000 or more, the
  1. commission must be composed of representatives selected by the following
  1. entities from among their members:
  1. (a) Two by the board.
  1. (b) Two by the governing body of the largest city.
  1. (c) One by the governing body of each additional city in the county.
  1. 2. In counties whose population is less than 100,000, the commission
  1. must be composed of representatives selected as follows:
  1. (a) If the county contains a city:
  1. (1) Two by the board.
  1. (2) One by the governing body of the largest city.
  1. (b) If the county contains no city, the board shall select:
  1. (1) Two members of the board; and
  1. (2) One representative of the public, who is a resident of the largest
  1. town, if any, in the county.
  1. 3. In Carson City, the commission must be composed of
  1. representatives selected by the board of supervisors as follows:
  1. (a) Two members of the board of supervisors.
  1. (b) One representative of the city at large.
  1. 4. The first representatives must be selected within 30 days after
  1. passage of the ordinance creating the commission, and, except as otherwise
  1. provided in [subsection 5,] subsections 5 and 6, must serve until the next
  1. ensuing December 31 of an even-numbered year. The representative of any
  1. city incorporated after passage of the ordinance must be selected within 30
  1. days after the first meeting of the governing body, and, except as otherwise
  1. provided in subsection [5,] 6, must serve until the next ensuing December
  1. 31 of an even-numbered year. Their successors must serve for terms of 2
  1. years, and vacancies must be filled for the unexpired term.
  1. 5. In counties whose population is 100,000 or more, but less than
  1. 400,000:
  1. (a) One representative selected by the board and one representative
  1. selected by the governing body of the largest city in the county must serve
  1. until the next ensuing December 31 of an even-numbered year; and
  2. (b) One representative selected by the board and one representative
  1. selected by the governing body of the largest city in the county must serve
  1. until the next ensuing December 31 of an odd-numbered year.
  1. 6. In counties whose population is 400,000 or more, the first
  1. representatives and the representative of any city incorporated after passage
  1. of the ordinance must serve until the next ensuing June 30 of an odd-
  1. numbered year.

Sec. 2. 1. The board of county commissioners of a county whose

population is 100,000 or more, but less than 400,000, shall, as soon as

practicable after the effective date of this act, designate one current

representative of the regional transportation commission created in that

county pursuant to NRS 373.030 who was selected pursuant to paragraph

(a) of subsection 1 of NRS 373.040 to serve a reduced term of office as a

representative of the commission. The term of office of the designated

representative expires on December 31, 1999.

2. The governing body of the largest city in a county whose population

is 100,000 or more, but less than 400,000, shall, as soon as practicable after

the effective date of this act, designate one current representative of the

regional transportation commission created in that county pursuant to NRS

373.030 who was selected pursuant to paragraph (b) of subsection 1 of

NRS 373.040 to serve a reduced term of office as a representative of the

commission. The term of office of the designated representative expires on

December 31, 1999.

3. The successors of those designated representatives whose terms of

office expire on December 31, 1999, pursuant to this section must serve for

terms of 2 years in accordance with the provisions of NRS 373.040.

4. A designated representative whose term of office expires pursuant to

this section may be selected to succeed himself.
