AN ACT relating to state government; creating the committee for public safety telecommunications operators in the department of motor vehicles and public safety; requiring agencies that employ persons as public safety telecommunications operators to require those persons to obtain certain certification and training; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 481 of NRS is hereby amended by adding thereto

1-2 the provisions set forth as sections 2 to 5, inclusive, of this act.

1-3 Sec. 2. As used in sections 2 to 5, inclusive, of this act, "public safety

1-4 telecommunications operator" means a person who operates a

1-5 telecommunications system for emergencies and public safety.

1-6 Sec. 3. 1. The committee for public safety telecommunications

1-7 operators is hereby created in the department.

1-8 2. The governor shall appoint to the committee seven members who

1-9 possess knowledge, skill and experience in the fields of law enforcement,

1-10 fire service training or telecommunications as follows:

1-11 (a) Two members from the field of law enforcement;

1-12 (b) Two members from the field of fire service training;

1-13 (c) Two members from the field of telecommunications; and

1-14 (d) One member from any field set forth in paragraph (a), (b) or (c).

1-15 3. Members serve terms of 2 years after the date of appointment.

2-1 4. Members serve without compensation but are entitled to the per

2-2 diem allowance and travel expenses provided by law for state officers and

2-3 employees generally.

2-4 Sec. 4. 1. The committee for public safety telecommunications

2-5 operators shall:

2-6 (a) Meet at the call of the chairman, who must be elected by the

2-7 members of the committee.

2-8 (b) Provide for and encourage the training and education of public

2-9 safety telecommunications operators.

2-10 (c) Adopt regulations establishing minimum standards for the

2-11 certification and training of public safety telecommunications operators.

2-12 (d) Make necessary inquiries to determine whether agencies of the

2-13 state and of local governments are complying with standards set forth in

2-14 its regulations.

2-15 2. The regulations adopted by the committee apply to all agencies of

2-16 the state and of local governments that employ persons as public safety

2-17 telecommunications operators.

2-18 3. The director may adopt regulations necessary for the operation of

2-19 the committee and the enforcement of laws administered by the

2-20 committee.

2-21 Sec. 5. Before an agency employs a person as a public safety

2-22 telecommunications operator, the agency shall require such a person to

2-23 obtain the certification and training required by the regulations adopted

2-24 pursuant to section 4 of this act.

2-25 Sec. 6. Notwithstanding the provisions of subsection 3 of section 3 of

2-26 this act, as soon as practicable after October 1, 1999, the governor shall,

2-27 pursuant to subsection 2 of section 3 of this act, appoint to the committee

2-28 for public safety telecommunications operators:

2-29 1. Two members whose initial terms expire on June 30, 2000;

2-30 2. Three members whose initial terms expire on June 30, 2001; and

2-31 3. Two members whose initial terms expire on June 30, 2002.

2-32 Sec. 7. The committee for public safety telecommunications operators

2-33 shall adopt the regulations required pursuant to paragraph (c) of subsection

2-34 1 of section 4 of this act before December 1, 1999.

2-35 Sec. 8. Notwithstanding the provisions of section 5 of this act, an

2-36 agency that employs a person as a public safety telecommunications

2-37 operator on or before October 1, 2000, is not required to require that

2-38 person to obtain the certification and training required by the regulations

2-39 adopted pursuant to section 4 of this act before July 1, 2001.
