AN ACT relating to agricultural districts; revising the provisions governing the terms of the members of a district board of agriculture for certain agricultural districts; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 547.040 is hereby amended to read as follows:

1-2 547.040 1. Not later than 10 days after an agricultural association is

1-3 formed within an agricultural district listed in NRS 547.010 pursuant to the

1-4 provisions of this chapter:

1-5 (a) The governor, if the agricultural district is [comprised] composed of

1-6 more than one county, shall appoint eight persons who are residents of the

1-7 agricultural district and who are members of the agricultural association to

1-8 be members of the district board of agriculture for the agricultural district;

1-9 or

1-10 (b) The board of county commissioners, if the agricultural district

1-11 constitutes a single-county agricultural district, shall appoint eight persons

1-12 who are residents of the agricultural district to be members of the district

1-13 board of agriculture for the agricultural district.

1-14 2. Within 10 days after their appointment, the persons so appointed

1-15 shall meet at a place within the agricultural district and organize by the

1-16 election of:

1-17 (a) One of their number as president of the district board of agriculture

1-18 and the agricultural association, who shall hold the office of president for

1-19 1 year and until his successor is elected.

2-1 (b) A secretary and a treasurer.

2-2 3. At the same meeting the members of the district board of

2-3 agriculture shall, by lot or otherwise, classify themselves into four classes

2-4 of two members each. The terms of office of [the] :

2-5 (a) The first class expire [at] :

2-6 (1) At the end of the first fiscal year [.The terms of office of the] if

2-7 the member was appointed to a district board of agriculture for an

2-8 agricultural district whose population is 100,000 or more as determined

2-9 by the population of the county or counties that compose the district; or

2-10 (2) On December 31 of the first fiscal year if the member was

2-11 appointed to a district board of agriculture for an agricultural district

2-12 whose population is less than 100,000 as determined by the population of

2-13 the county or counties that compose the district.

2-14 (b) The second class expire [at] :

2-15 (1) At the end of the second fiscal year [.The terms of office of the] if

2-16 the member was appointed to a district board of agriculture for an

2-17 agricultural district whose population is 100,000 or more as determined

2-18 by the population of the county or counties that compose the district; or

2-19 (2) On December 31 of the second fiscal year if the member was

2-20 appointed to a district board of agriculture whose population is less than

2-21 100,000 as determined by the population of the county or counties that

2-22 compose the district.

2-23 (c) The third class expire [at] :

2-24 (1) At the end of the third fiscal year [. The terms of office of the] if

2-25 the member was appointed to a district board of agriculture for an

2-26 agricultural district whose population is 100,000 or more as determined

2-27 by the population of the county or counties that compose the district; or

2-28 (2) On December 31 of the third fiscal year if the member was

2-29 appointed to a district board of agriculture for an agricultural district

2-30 whose population is less than 100,000 as determined by the population of

2-31 the county or counties that compose the district.

2-32 (d) The fourth class expire [at] :

2-33 (1) At the end of the fourth fiscal year [.] if the member was

2-34 appointed to a district board of agriculture for an agricultural district

2-35 whose population is 100,000 or more as determined by the population of

2-36 the county or counties that compose the district; or

2-37 (2) On December 31 of the fourth fiscal year if the member was

2-38 appointed to a district board of agriculture for an agricultural district

2-39 whose population is less than 100,000 as determined by the population of

2-40 the county or counties that compose the district.

3-1 Sec. 2. NRS 547.060 is hereby amended to read as follows:

3-2 547.060 1. Except as otherwise provided in subsection 3 of NRS

3-3 547.040, each [director] member of a district board of agriculture must be

3-4 appointed for a term of 4 years. The term begins on:

3-5 (a) July 1, if the member was appointed to a district board of

3-6 agriculture for an agricultural district whose population is 100,000 or

3-7 more as determined by the population of the county or counties that

3-8 compose the district; or

3-9 (b) January 1, if the member was appointed to a district board of

3-10 agriculture for an agricultural district whose population is less than

3-11 100,000 as determined by the population of the county or counties that

3-12 compose the district.

3-13 2. The secretary shall report any vacancy which may occur in the

3-14 district board of agriculture to its appointing authority as specified in NRS

3-15 547.040, and the vacancy must be filled by appointment for the unexpired

3-16 term.

3-17 3. The incumbent members of the district board of agriculture may

3-18 submit to the appointing authority for consideration a list of nominees for

3-19 appointment to fill any vacancy on the [district] board.

3-20 Sec. 3. Notwithstanding the provisions of NRS 547.040 and 547.060

3-21 to the contrary, the term of a member of a district board of agriculture for

3-22 an agricultural district whose population is less than 100,000, as

3-23 determined by the population of the county or counties that compose the

3-24 district, that would otherwise expire on:

3-25 1. June 30, 2000, expires on December 31, 1999.

3-26 2. June 30, 2001, expires on December 31, 2000.

3-27 3. June 30, 2002, expires on December 31, 2001.

3-28 4. June 30, 2003, expires on December 31, 2002.
