AN ACT relating to highways; clarifying the authority of the department of transportation to include in a contract made or awarded for the construction, improvement, maintenance or repair of a highway or appurtenance to a highway a provision for the payment of an additional amount of money if the construction, improvement, maintenance or repair is completed before a certain date; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 408 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Any contract made or awarded by the department for the

1-4 construction, improvement, maintenance or repair of a highway or an

1-5 appurtenance to that highway may include a provision for the payment

1-6 of an additional amount of money to the person with whom the contract

1-7 is made or to whom it is awarded if he satisfactorily completes the

1-8 construction, improvement, maintenance or repair of the highway or

1-9 appurtenance before the date for completion of that construction,

1-10 improvement, maintenance or repair set forth in the contract.

2-1 2. The amount of money to be paid pursuant to a provision included

2-2 in a contract specified in subsection 1 and the date before which the work

2-3 must be completed must be determined by the department.
