THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 388 of NRS is hereby amended by adding thereto1-2
the provisions set forth as sections 2 to 10, inclusive, of this act.1-3
Sec. 2. As used in sections 2 to 10, inclusive, of this act, unless the1-4
context otherwise requires, the words and terms defined in sections 3, 41-5
and 5 of this act have the meanings ascribed to them in those sections.1-6
Sec. 3. "Intersession school" means instruction that is provided1-7
between regularly scheduled sessions of school in a school that operates1-8
on a year-round schedule or other alternative schedule.1-9
Sec. 4. "Program" means the program for the financial support of1-10
intersession school and summer school.1-11
Sec. 5. "Summer school" means instruction that is provided during1-12
the summer months in a school that operates on a regular school1-13
schedule which is not a year-round schedule or other alternative1-14
schedule.2-1
Sec. 6. 1. The program for the financial support of intersession2-2
school and summer school is hereby established to assist school districts2-3
in providing intersession school and summer school.2-4
2. The department shall adopt regulations that:2-5
(a) Establish criteria for the eligibility of school districts to participate2-6
in the program;2-7
(b) Prescribe the annual deadline for submission of an application to2-8
the department by a school district that desires to participate in the2-9
program;2-10
(c) Provide for the reversion of any unused portion of an annual2-11
allocation; and2-12
(d) Prescribe the deadline for submission of a report to the department2-13
pursuant to section 10 of this act.2-14
Sec. 7. Annually, the board of trustees of a school district may2-15
submit to the department an application, on a form provided by the2-16
department, to participate in the program. The application must contain2-17
the following information regarding the proposed operation of2-18
intersession school or summer school by the board of trustees:2-19
1. Whether the board of trustees proposes to operate intersession2-20
school or summer school, or both;2-21
2. The courses of instruction that will be offered;2-22
3. The projected enrollment of pupils in intersession school or2-23
summer school, as applicable, for the year, including the categories of2-24
pupils who are expected to participate;2-25
4. The method by which the success of intersession school or2-26
summer school, as applicable, will be evaluated;2-27
5. The financial requirements of the school district to operate2-28
intersession school or summer school, as applicable; and2-29
6. Such other information as the department requires.2-30
Sec. 8. 1. If an application is submitted by the deadline prescribed2-31
by the department, the department shall review the application. If the2-32
application meets the criteria for eligibility adopted by the department,2-33
the department shall approve the application.2-34
2. The department shall apportion the money available for the2-35
program for that year among the school districts whose applications for2-36
participation have been approved. The money available for the program2-37
must be apportioned to each school district in proportion to the total2-38
number of pupils enrolled in public schools within the school district on2-39
the last day of the first month of the school year preceding the school2-40
year for which the money is being provided.2-41
3. The department shall reallocate any unused allocations to school2-42
districts who participate in the program based upon the need of each2-43
school district, as determined by the department.3-1
Sec. 9. 1. If a school district participates in the program, it must3-2
provide intersession school or summer school, as applicable, for pupils:3-3
(a) Who attend schools that have been designated as demonstrating3-4
inadequate achievement pursuant to NRS 385.367;3-5
(b) Who attend schools that receive pupils who were previously3-6
enrolled in schools that have been designated as demonstrating3-7
inadequate achievement pursuant to NRS 387.367;3-8
(c) Whose primary language is not English and whose proficiency in3-9
the English language is below the average proficiency of pupils at the3-10
same grade level;3-11
(d) Who lack sufficient course work or academic credit to advance to3-12
the next grade or to graduate from school;3-13
(e) Who are from families of low income;3-14
(f) Who fail to demonstrate at least adequate achievement on the3-15
examinations administered pursuant to NRS 389.015; and3-16
(g) Who desire to obtain additional academic credit or complete3-17
additional course work.3-18
2. A school district that participates in the program is not required to3-19
furnish transportation for pupils who attend intersession school or3-20
summer school.3-21
Sec. 10. The board of trustees of a school district that participates in3-22
the program shall submit a report to the department on a form provided3-23
by the department. The report must contain the following information3-24
regarding the operation of intersession school or summer school during3-25
the immediately preceding 12 months:3-26
1. A list of the schools within the school district that operated3-27
intersession school or summer school, or both;3-28
2. A list of the courses of instruction that were offered by each school3-29
that operated intersession school or summer school, or both;3-30
3. A statement of the total enrollment of pupils in intersession school3-31
or summer school, as applicable, for the year, including, without3-32
limitation, an itemized list of the number of pupils in each category3-33
described in paragraphs (a) to (g), inclusive, of subsection 1 of section 93-34
of this act who enrolled in intersession school or summer school;3-35
4. The evaluation of the success of intersession school or summer3-36
school in accordance with the method for evaluation set forth by the3-37
board of trustees pursuant to subsection 4 of section 7 of this act;3-38
5. A statement of the costs incurred by the schools to operate3-39
intersession school or summer school;3-40
6. A statement of the financial resources necessary for the schools to3-41
continue to operate intersession school or summer school; and3-42
7. Such other information as the department requires.4-1
Sec. 11. 1. There is hereby appropriated from the state general fund4-2
to the department of education for the program for the financial support of4-3
intersession school and summer school:4-4
For the fiscal year 1999-2000 $2,000,0004-5
For the fiscal year 2000-2001 $2,000,0004-6
2. The department of education shall use not more than 3 percent of the4-7
money appropriated by subsection 1 to conduct an evaluation of the success4-8
of the program for the financial support of intersession school and summer4-9
school. The evaluation must include, without limitation, a review of the4-10
annual reports submitted by the board of trustees of the school districts that4-11
participate in the program. On or before March 1, 2001, the department of4-12
education shall submit a written report that contains the results of the4-13
evaluation to the legislative bureau of educational accountability and4-14
program evaluation and to the director of the legislative counsel bureau for4-15
transmission to the 71st session of the Nevada legislature.4-16
3. Any remaining balance of the appropriation made by subsection 14-17
for:4-18
(a) The fiscal year 1999-2000 must be transferred and added to the4-19
money appropriated for the fiscal year 2000-2001.4-20
(b) The fiscal year 2000-2001, including any money added thereto4-21
pursuant to paragraph (a), must not be committed for expenditure after June4-22
30, 2001, and reverts to the state general fund as soon as all payments of4-23
money committed have been made.4-24
Sec. 12. 1. This section and section 11 of this act become effective4-25
upon passage and approval.4-26
2. Section 6 of this act becomes effective upon passage and approval4-27
for the purpose of adopting regulations and on July 1, 1999, for all other4-28
purposes.4-29
3. Sections 1 to 5, inclusive, and 7 to 10, inclusive, of this act become4-30
effective on July 1, 1999.~
