AN ACT relating to long-term care; requiring the Department of Human Resources to conduct a study of facilities for long-term care that provide services to recipients of Medicaid; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. 1. The Department of Human Resources shall:

1-2 (a) Conduct a study to determine:

1-3 (1) Whether the staffing for facilities for long-term care that provide

1-4 services to recipients of Medicaid is satisfactory;

1-5 (2) Whether the rates of reimbursement from the state plan for Medicaid

1-6 to such facilities for long-term care are satisfactory; and

1-7 (3) How those rates relate to the federal rates of reimbursement for

1-8 skilled nursing facilities which are published pursuant to 42 C.F.R. § 413.345

1-9 and which are calculated using the current version of the Resource Utilization

1-10 Groups method of calculation, as referred to in 42 C.F.R. § 413.333; and

1-11 (b) On or before July 1, 2000, submit its findings and recommendations to

1-12 the Legislative Committee on Health Care.

1-13 2. The Legislative Committee on Health Care shall:

1-14 (a) Review the findings and recommendations submitted by the Department

1-15 of Human Resources;

1-16 (b) Submit any recommendations as a result of that review to the Interim

1-17 Finance Committee; and

2-1 (c) Submit any recommendations for legislation to the 71st session of the

2-2 Nevada Legislature.

2-3 Sec. 2. This act becomes effective on July 1, 1999.
