AN ACT relating to traffic laws; clarifying the prohibition against entering or proceeding through an intersection while driving within a pathway or lane provided for bicycles; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 484.324 is hereby amended to read as follows:

1-2 484.324 1. The driver of a motor vehicle shall not:

1-3 (a) Intentionally interfere with the movement of a person lawfully riding

1-4 a bicycle; or

1-5 (b) Overtake and pass a person riding a bicycle unless he can do so

1-6 safely without endangering the person riding the bicycle.

1-7 2. The driver of a motor vehicle shall yield the right of way to any

1-8 person riding a bicycle on the pathway or lane. The driver of a motor

1-9 vehicle shall not stop, stand, park or drive within a pathway or lane

1-10 provided for bicycles except:

1-11 (a) When preparing to make or making a turn;

1-12 (b) When entering or exiting an alley or driveway;

1-13 (c) When operating or parking a disabled vehicle;

1-14 (d) To avoid conflict with other traffic;

1-15 (e) In the performance of official duties;

1-16 (f) In compliance with the directions of a police officer; or

1-17 (g) In an emergency.

2-1 3. Except as otherwise provided in subsection 2, the driver of a motor

2-2 vehicle shall not enter or proceed through an intersection while driving

2-3 within a pathway or lane provided for bicycles.

2-4 4. The driver of a motor vehicle shall:

2-5 (a) Exercise due care to avoid a collision with a person riding a bicycle;

2-6 and

2-7 (b) Give an audible warning with the horn of the vehicle if appropriate

2-8 and when necessary to avoid such a collision.

2-9 [4.] 5. The operator of a bicycle shall not:

2-10 (a) Intentionally interfere with the movement of a motor vehicle; or

2-11 (b) Overtake and pass a motor vehicle unless he can do so safely without

2-12 endangering himself or the occupants of the motor vehicle.
