AN ACT relating to historic preservation; authorizing the board of directors of the Las Vegas Valley water district to establish and maintain a desert preserve located in or within the vicinity of the Big Spring Archeological District; providing for the issuance of special license plates to support the desert preserve; imposing a fee for the issuance or renewal of those license plates; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 482 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in this subsection, the department

1-4 shall, in cooperation with the board of directors of the Las Vegas Valley

1-5 water district, design, prepare and issue license plates to support the

1-6 desert preserve established by the board of directors of the Las Vegas

1-7 Valley water district. The license plates may include any colors and

1-8 designs that the department deems appropriate.

1-9 2. The department may issue license plates specified in subsection 1

1-10 for a passenger car or light commercial vehicle upon application by a

1-11 person who is entitled to license plates pursuant to the provisions of NRS

1-12 482.265 and who otherwise complies with the requirements for

1-13 registration and licensing pursuant to the provisions of this chapter. A

1-14 person may request that personalized prestige license plates issued

1-15 pursuant to the provisions of NRS 482.3667 be combined with license

2-1 plates specified in subsection 1 if that person pays, in addition to the fees

2-2 specified in subsections 3 and 4, the fees for the personalized prestige

2-3 license plates.

2-4 3. The fee for license plates specified in subsection 1 is $35. The fee

2-5 is in addition to any other applicable registration and license fees and

2-6 motor vehicle privilege taxes. The license plates are renewable upon the

2-7 payment of $10.

2-8 4. In addition to the fees for the license, registration and privilege

2-9 taxes, a person who requests the issuance of license plates specified in

2-10 subsection 1 must pay:

2-11 (a) For the initial issuance of the plates an additional fee of $25; and

2-12 (b) For each renewal of the plates an additional $20 to support the

2-13 desert preserve specified in subsection 1.

2-14 5. The department shall deposit the fees collected pursuant to the

2-15 provisions of subsection 4 with the state treasurer for credit to an account

2-16 for the support of the desert preserve established by the board of directors

2-17 of the Las Vegas Valley water district. On or before January 1, April 1,

2-18 July 1 and October 1 of each year, the state controller shall distribute the

2-19 money deposited in the account for the preceding quarter to the board of

2-20 directors of the Las Vegas Valley water district.

2-21 6. If, during a registration year, the holder of license plates issued

2-22 pursuant to the provisions of this section disposes of the vehicle to which

2-23 the plates are affixed, he may retain the plates and:

2-24 (a) Affix the license plates to another vehicle that meets the

2-25 requirements of this section if the transfer and registration fees are paid

2-26 pursuant to the provisions of this chapter; or

2-27 (b) Within 30 days after removing the plates from the vehicle, return

2-28 the plates to the department.

2-29 Sec. 2. NRS 482.2703 is hereby amended to read as follows:

2-30 482.2703 1. The director may order the preparation of sample license

2-31 plates which must be of the same design and size as regular license plates

2-32 or license plates issued pursuant to NRS 482.384. The director shall ensure

2-33 that:

2-34 (a) Each license plate issued pursuant to this subsection, regardless of its

2-35 design, is inscribed with the word SAMPLE and an identical designation

2-36 which consists of the same group of three numerals followed by the same

2-37 group of three letters; and

2-38 (b) The designation of numerals and letters assigned pursuant to

2-39 paragraph (a) is not assigned to a vehicle registered pursuant to this chapter

2-40 or chapter 706 of NRS.

3-1 2. The director may order the preparation of sample license plates

3-2 which must be of the same design and size as any of the special license

3-3 plates issued pursuant to NRS 482.3667 to 482.3823, inclusive [.] , and

3-4 section 1 of this act. The director shall ensure that:

3-5 (a) Each license plate issued pursuant to this subsection, regardless of its

3-6 design, is inscribed with the word SAMPLE and the number zero in the

3-7 location where any other numerals would normally be displayed on a

3-8 license plate of that design; and

3-9 (b) The number assigned pursuant to paragraph (a) is not assigned to a

3-10 vehicle registered pursuant to this chapter or chapter 706 of NRS.

3-11 3. The director may establish a fee for the issuance of sample license

3-12 plates of not more than $15 for each license plate.

3-13 4. A decal issued pursuant to NRS 482.271 may be displayed on a

3-14 sample license plate issued pursuant to this section.

3-15 5. All money collected from the issuance of sample license plates must

3-16 be deposited in the state treasury for credit to the motor vehicle fund.

3-17 6. A person shall not affix a sample license plate issued pursuant to this

3-18 section to a vehicle. A person who violates the provisions of this subsection

3-19 is guilty of a misdemeanor.

3-20 Sec. 3. NRS 482.500 is hereby amended to read as follows:

3-21 482.500 1. Except as otherwise provided in subsection 2, whenever

3-22 upon application any duplicate or substitute certificate of registration, decal

3-23 or number plate is issued, the following fees must be paid:

3-24 For a certificate of registration $5.00

3-25 For every substitute number plate or set of plates 5.00

3-26 For every duplicate number plate or set of plates 10.00

3-27 For every decal displaying a county name .50

3-28 For every other decal , [(] license plate sticker or tab [)] 5.00

3-29 2. The following fees must be paid for any replacement plate or set of

3-30 plates issued for the following special license plates:

3-31 (a) For any special plate issued pursuant to NRS 482.3667, 482.3672,

3-32 482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,

3-33 inclusive, and section 1 of this act, a fee of $10.

3-34 (b) For any special plate issued pursuant to NRS 482.368, 482.3765,

3-35 482.377 or 482.378, a fee of $5.

3-36 (c) For any souvenir license plate issued pursuant to NRS 482.3825 or

3-37 sample license plate issued pursuant to NRS 482.2703, a fee equal to that

3-38 established by the director for the issuance of those plates.

4-1 3. The fees which are paid for duplicate number plates and decals

4-2 displaying county names must be deposited with the state treasurer for

4-3 credit to the motor vehicle fund and allocated to the department to defray

4-4 the costs of duplicating the plates and manufacturing the decals.

4-5 4. As used in this section:

4-6 (a) "Duplicate number plate" means a license plate or a set of license

4-7 plates issued to a registered owner which repeat the code of a plate or set of

4-8 plates previously issued to the owner to maintain his registration using the

4-9 same code.

4-10 (b) "Substitute number plate" means a license plate or a set of license

4-11 plates issued in place of a previously issued and unexpired plate or set of

4-12 plates. The plate or set of plates does not repeat the code of the previously

4-13 issued plate or set.

4-14 Sec. 4. Chapter 167, Statutes of Nevada 1947, as last amended by

4-15 chapter 506, Statutes of Nevada 1997, at page 2404, is hereby amended by

4-16 adding thereto a new section to be designated as section 29, immediately

4-17 following section 28, to read as follows:

4-18 Sec. 29. 1. The board of directors may establish and maintain

4-19 a desert preserve located in or within the vicinity of the Big Spring

4-20 Archeological District. The preserve may include, without

4-21 limitation:

4-22 (a) Exhibits demonstrating conservation, the use of water,

4-23 horticulture or the history of Southern Nevada; and

4-24 (b) Any other features associated with the topography, geology or

4-25 history of Nevada.

4-26 2. The board of directors may create a board of trustees to

4-27 supervise the development of the desert preserve established

4-28 pursuant to the provisions of subsection 1. If a board of trustees is

4-29 created, the members of the board of trustees may:

4-30 (a) Enter into agreements to establish and maintain any exhibits,

4-31 attractions or facilities for visitors included in the preserve; and

4-32 (b) Accept gifts, grants, contributions or donations of money or

4-33 property for the establishment or management of the desert

4-34 preserve.

4-35 3. To the greatest extent practicable, the board of directors and

4-36 the board of trustees if created pursuant to the provisions of

4-37 subsection 2, shall fund and operate the preserve with money

4-38 received pursuant to the provisions of paragraph (b) of subsection 2.

4-39 Sec. 5. On or before October 1, 2003, the department of motor

4-40 vehicles and public safety shall determine and publicly declare the number

4-41 of applications it has received for the issuance of license plates pursuant to

4-42 the provisions of section 1 of this act.

5-1 Sec. 6. The amendatory provisions of sections 1, 2 and 3 of this act

5-2 expire by limitation on October 1, 2003, if on that date the department of

5-3 motor vehicles and public safety has received less than 250 applications for

5-4 the issuance of license plates pursuant to the provisions of section 1 of this

5-5 act.
