AN ACT relating to historic preservation; authorizing the board of directors of the Las Vegas

Valley water district to establish and maintain a desert preserve located in or within

the vicinity of the Big Spring Archeological District; providing for the issuance of

special license plates to support the desert preserve; imposing a fee for the issuance

or renewal of those license plates; and providing other matters properly relating

thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 482 of NRS is hereby amended by adding thereto a

new section to read as follows:

1. Except as otherwise provided in this subsection, the department

shall, in cooperation with the board of directors of the Las Vegas Valley

water district, design, prepare and issue license plates to support the

desert preserve established by the board of directors of the Las Vegas

Valley water district. The license plates may include any colors and

designs that the department deems appropriate.

2. The department may issue license plates specified in subsection 1

for a passenger car or light commercial vehicle upon application by a

person who is entitled to license plates pursuant to the provisions of NRS

482.265 and who otherwise complies with the requirements for

registration and licensing pursuant to the provisions of this chapter. A

person may request that personalized prestige license plates issued

pursuant to the provisions of NRS 482.3667 be combined with license

plates specified in subsection 1 if that person pays, in addition to the fees

specified in subsections 3 and 4, the fees for the personalized prestige

license plates.

3. The fee for license plates specified in subsection 1 is $35. The fee

is in addition to any other applicable registration and license fees and

motor vehicle privilege taxes. The license plates are renewable upon the

payment of $10.

4. In addition to the fees for the license, registration and privilege

taxes, a person who requests the issuance of license plates specified in

subsection 1 must pay:

(a) For the initial issuance of the plates an additional fee of $25; and

(b) For each renewal of the plates an additional $20 to support the

desert preserve specified in subsection 1.

5. The department shall deposit the fees collected pursuant to the

provisions of subsection 4 with the state treasurer for credit to an account

for the support of the desert preserve established by the board of directors

of the Las Vegas Valley water district. On or before January 1, April 1,

July 1 and October 1 of each year, the state controller shall distribute the

money deposited in the account for the preceding quarter to the board of

directors of the Las Vegas Valley water district.

6. If, during a registration year, the holder of license plates issued

pursuant to the provisions of this section disposes of the vehicle to which

the plates are affixed, he may retain the plates and:

(a) Affix the license plates to another vehicle that meets the

requirements of this section if the transfer and registration fees are paid

pursuant to the provisions of this chapter; or

(b) Within 30 days after removing the plates from the vehicle, return

the plates to the department.

Sec. 2. NRS 482.2703 is hereby amended to read as follows:

  1. 482.2703 1. The director may order the preparation of sample license
  1. plates which must be of the same design and size as regular license plates
  1. or license plates issued pursuant to NRS 482.384. The director shall ensure
  1. that:
  1. (a) Each license plate issued pursuant to this subsection, regardless of its
  1. design, is inscribed with the word SAMPLE and an identical designation
  1. which consists of the same group of three numerals followed by the same
  1. group of three letters; and
  1. (b) The designation of numerals and letters assigned pursuant to
  1. paragraph (a) is not assigned to a vehicle registered pursuant to this chapter
  1. or chapter 706 of NRS.
  1. 2. The director may order the preparation of sample license plates
  1. which must be of the same design and size as any of the special license
  1. plates issued pursuant to NRS 482.3667 to 482.3823, inclusive [.] , and
  1. section 1 of this act. The director shall ensure that:
  1. (a) Each license plate issued pursuant to this subsection, regardless of its
  1. design, is inscribed with the word SAMPLE and the number zero in the
  1. location where any other numerals would normally be displayed on a
  1. license plate of that design; and
  1. (b) The number assigned pursuant to paragraph (a) is not assigned to a
  1. vehicle registered pursuant to this chapter or chapter 706 of NRS.
  1. 3. The director may establish a fee for the issuance of sample license
  1. plates of not more than $15 for each license plate.
  1. 4. A decal issued pursuant to NRS 482.271 may be displayed on a
  1. sample license plate issued pursuant to this section.
  1. 5. All money collected from the issuance of sample license plates must
  1. be deposited in the state treasury for credit to the motor vehicle fund.
  1. 6. A person shall not affix a sample license plate issued pursuant to this
  1. section to a vehicle. A person who violates the provisions of this subsection
  1. is guilty of a misdemeanor.

Sec. 3. NRS 482.500 is hereby amended to read as follows:

  1. 482.500 1. Except as otherwise provided in subsection 2, whenever
  1. upon application any duplicate or substitute certificate of registration, decal
  1. or number plate is issued, the following fees must be paid:
  1. For a certificate of registration $5.00
  1. For every substitute number plate or set of plates 5.00
  1. For every duplicate number plate or set of plates 10.00
  1. For every decal displaying a county name .50
  1. For every other decal , [(] license plate sticker or tab [)] 5.00
  1. 2. The following fees must be paid for any replacement plate or set of
  1. plates issued for the following special license plates:
  1. (a) For any special plate issued pursuant to NRS 482.3667, 482.3672,
  1. 482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,
  1. inclusive, and section 1 of this act, a fee of $10.
  1. (b) For any special plate issued pursuant to NRS 482.368, 482.3765,
  1. 482.377 or 482.378, a fee of $5.
  1. (c) For any souvenir license plate issued pursuant to NRS 482.3825 or
  1. sample license plate issued pursuant to NRS 482.2703, a fee equal to that
  1. established by the director for the issuance of those plates.
  1. 3. The fees which are paid for duplicate number plates and decals
  1. displaying county names must be deposited with the state treasurer for
  1. credit to the motor vehicle fund and allocated to the department to defray
  1. the costs of duplicating the plates and manufacturing the decals.
  1. 4. As used in this section:
  1. (a) "Duplicate number plate" means a license plate or a set of license
  1. plates issued to a registered owner which repeat the code of a plate or set of
  1. plates previously issued to the owner to maintain his registration using the
  1. same code.
  1. (b) "Substitute number plate" means a license plate or a set of license
  1. plates issued in place of a previously issued and unexpired plate or set of
  1. plates. The plate or set of plates does not repeat the code of the previously
  1. issued plate or set.

Sec. 4. Chapter 167, Statutes of Nevada 1947, as last amended by

chapter 506, Statutes of Nevada 1997, at page 2404, is hereby amended by

adding thereto a new section to be designated as section 29, immediately

following section 28, to read as follows:

Sec. 29. 1. The board of directors may establish and maintain

a desert preserve located in or within the vicinity of the Big Spring

Archeological District. The preserve may include, without

limitation:

(a) Exhibits demonstrating conservation, the use of water,

horticulture or the history of Southern Nevada; and

(b) Any other features associated with the topography, geology or

history of Nevada.

2. The board of directors may create a board of trustees to

supervise the development of the desert preserve established

pursuant to the provisions of subsection 1. If a board of trustees is

created, the members of the board of trustees may:

(a) Enter into agreements to establish and maintain any exhibits,

attractions or facilities for visitors included in the preserve; and

(b) Accept gifts, grants, contributions or donations of money or

property for the establishment or management of the desert

preserve.

3. To the greatest extent practicable, the board of directors and

the board of trustees if created pursuant to the provisions of

subsection 2, shall fund and operate the preserve with money

received pursuant to the provisions of paragraph (b) of subsection 2.

Sec. 5. On or before October 1, 2003, the department of motor

vehicles and public safety shall determine and publicly declare the number

of applications it has received for the issuance of license plates pursuant to

the provisions of section 1 of this act.

Sec. 6. The amendatory provisions of sections 1, 2 and 3 of this act

expire by limitation on October 1, 2003, if on that date the department of

motor vehicles and public safety has received less than 250 applications for

the issuance of license plates pursuant to the provisions of section 1 of this

act.
