CHAPTER........
AN ACT relating to education; making various changes regarding the administration,
required reporting and security of the achievement and proficiency examinations
administered to pupils in public schools; providing administrative penalties for
breaches of the security or confidentiality of the achievement and proficiency
examinations; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. NRS 389.015 is hereby amended to read as follows:
8. The state board shall prescribe, in accordance with the Individuals
with Disabilities Education Act, 20 U.S.C. §§ 1400 et seq., the
modifications and accommodations that may be used in the
administration of an examination to a pupil with a disability who is
unable to take the examination under regular testing conditions or with
the modifications and accommodations approved by the publisher of the
examination.
Sec. 2. NRS 389.017 is hereby amended to read as follows:
(a) His
primary language is not English and his proficiency in theEnglish language is below the average proficiency of pupils at the same
grade level
language prescribed by the state board;

NRS 391.312 is hereby amended to read as follows:Sec. 4. NRS 391.330 is hereby amended to read as follows:
Sec. 5. This act becomes effective on July 1, 1999.
