AN ACT relating to public assistance; requiring the inclusion of the administration of the children’s health insurance program within the administration of Medicaid; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 422 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise required by the Federal Government, either

1-4 directly or as a condition to the receipt of federal money, the welfare

1-5 division shall:

1-6 (a) Include within the administration of Medicaid the administration

1-7 of the children’s health insurance program; and

1-8 (b) In carrying out paragraph (a), combine all possible administrative

1-9 procedures, including, without limitation, applications for participation

1-10 in and determinations of eligibility for such programs.

1-11 2. As used in this section, "children’s health insurance program"

1-12 means the program established pursuant to 42 U.S.C. §§ 1397aa to

1-13 1397jj, inclusive, to provide health insurance to uninsured children from

1-14 low-income families in this state.

2-1 Sec. 2. NRS 422.222 is hereby amended to read as follows:

2-2 422.222 1. The administrator may adopt such regulations as are

2-3 necessary for the administration of NRS 422.070 to 422.410, inclusive, and

2-4 section 1 of this act, and any program of the welfare division.

2-5 2. A regulation adopted by the administrator becomes effective upon

2-6 adoption or such other date as the administrator specifies in the regulation.

2-7 Sec. 3. 1. This section and section 1 of this act become effective on

2-8 July 1, 1999.

2-9 2. Section 2 of this act becomes effective at 12:01 a.m. on July 1, 1999.
