AN ACT relating to state employment; authorizing the department of prisons to suspend without pay peace officers and certain other employees under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 284 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Notwithstanding the provisions of NRS 284.385, the department of

1-4 prisons may suspend without pay a peace officer or an employee who has

1-5 access to records or reports that are confidential if:

1-6 (a) The peace officer or employee is arrested for a felony;

1-7 (b) The department of prisons reasonably believes the suspension

1-8 without pay:

1-9 (1) Is in the best interest of the public; or

1-10 (2) Will ensure the safety and security of a facility or institution;

1-11 and

1-12 (c) The suspension begins within a reasonable time after the arrest.

1-13 2. A suspension without pay does not become effective until the

1-14 peace officer or employee is notified in writing of the suspension and the

1-15 reason for the suspension.

2-1 3. For the purposes of this section:

2-2 (a) "Facility" has the meaning ascribed to it in NRS 209.065.

2-3 (b) "Institution" has the meaning ascribed to it in NRS 209.071.
