AN ACT relating to traffic laws; providing standards for making a right turn under certain circumstances; deleting the provision which allows a driver of a motor vehicle to stop, stand, park or drive within a pathway or lane provided for bicycles if he is preparing to make or making a turn; clarifying the prohibition against entering or proceeding through an intersection while driving within a pathway or lane provided for bicycles; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 484.305 is hereby amended to read as follows:

1-2 484.305 1. [Whenever any] If a highway has two or more clearly

1-3 marked lanes for traffic traveling in one direction, vehicles [shall be] must:

1-4 (a) Be driven as nearly as practicable entirely within a single lane ; and

1-5 [shall not]

1-6 (b) Not be moved from [such] that lane until the driver has given the

1-7 appropriate turn signal and ascertained that such movement can be made

1-8 with safety.

1-9 2. Upon a highway which has been divided into three clearly marked

1-10 lanes a vehicle [shall] must not be driven in the extreme left lane at any

1-11 time. A vehicle on such a highway [shall] must not be driven in the center

1-12 lane except:

1-13 (a) When overtaking and passing another vehicle where the highway is

1-14 clearly visible and [such] the center lane is clear of traffic for a safe

1-15 distance;

1-16 (b) In preparation for a left turn; or

2-1 (c) [Where such] When the center lane is [at the time] allocated

2-2 exclusively to traffic moving in the direction in which the vehicle is

2-3 proceeding [,] and a sign is posted to give notice of such allocation.

2-4 3. [Whenever] If a highway has been designed to provide a single

2-5 center lane to be used only for turning [,] by traffic moving in both

2-6 directions, the following rules apply:

2-7 (a) A vehicle [shall] may be driven in the center turn lane only for the

2-8 purpose of making a left-hand turn.

2-9 (b) A vehicle [shall] must not travel more than 200 feet in a center turn

2-10 lane [prior to] before making a left-hand turn.

2-11 4. If a highway has been designed to provide a single right lane to be

2-12 used only for turning, a vehicle must:

2-13 (a) Be driven in the right turn lane only for the purpose of making a

2-14 right turn; and

2-15 (b) While being driven in the right turn lane, not travel through an

2-16 intersection.

2-17 Sec. 2. NRS 484.324 is hereby amended to read as follows:

2-18 484.324 1. The driver of a motor vehicle shall not:

2-19 (a) Intentionally interfere with the movement of a person lawfully riding

2-20 a bicycle; or

2-21 (b) Overtake and pass a person riding a bicycle unless he can do so

2-22 safely without endangering the person riding the bicycle.

2-23 2. The driver of a motor vehicle shall yield the right of way to any

2-24 person riding a bicycle on the pathway or lane. The driver of a motor

2-25 vehicle shall not enter, stop, stand, park or drive within a pathway or lane

2-26 provided for bicycles except:

2-27 (a) [When preparing to make or making a turn;

2-28 (b)] When entering or exiting an alley or driveway;

2-29 [(c)] (b) When operating or parking a disabled vehicle;

2-30 [(d)] (c) To avoid conflict with other traffic;

2-31 [(e)] (d) In the performance of official duties;

2-32 [(f)] (e) In compliance with the directions of a police officer; or

2-33 [(g)] (f) In an emergency.

2-34 3. Except as otherwise provided in subsection 2, the driver of a motor

2-35 vehicle shall not enter or proceed through an intersection while driving

2-36 within a pathway or lane provided for bicycles.

2-37 4. The driver of a motor vehicle shall:

2-38 (a) Exercise due care to avoid a collision with a person riding a bicycle;

2-39 and

2-40 (b) Give an audible warning with the horn of the vehicle if appropriate

2-41 and when necessary to avoid such a collision.

2-42 [4.] 5. The operator of a bicycle shall not:

2-43 (a) Intentionally interfere with the movement of a motor vehicle; or

3-1 (b) Overtake and pass a motor vehicle unless he can do so safely without

3-2 endangering himself or the occupants of the motor vehicle.

3-3 Sec. 3. NRS 484.333 is hereby amended to read as follows:

3-4 484.333 [When] If the driver of a vehicle intends to turn at an

3-5 intersection [:

3-6 1. When the] and:

3-7 1. The turn is a right turn, both the approach for the right turn and the

3-8 right turn [shall] must be made [as close as practicable to the right-hand

3-9 curb or edge of the highway.

3-10 2. Where both] from the right turn lane if the highway has a right

3-11 turn lane as set forth in subsection 4 of NRS 484.305, or must be made

3-12 from the extreme right lane.

3-13 2. Both intersecting highways are two-directional [, the] :

3-14 (a) The approach for a left turn [shall] must be made in that portion of

3-15 the right half of the highway nearest the centerline thereof; [and after]

3-16 (b) After entering the intersection , the left turn [shall] must be made so

3-17 as to leave the intersection to the right of the centerline of the highway

3-18 being entered; and [in all cases, except where]

3-19 (c) Except as otherwise directed by official traffic-control devices,

3-20 simultaneous left turns by opposing traffic [shall] must be made in front of

3-21 each other.

3-22 3. [When the] The turn is a left turn from a two-directional highway

3-23 [into] onto a one-way highway, the approach for [a] the left turn [shall]

3-24 must be made in that portion of the right half of the highway nearest the

3-25 centerline thereof , and the turn [shall] must be made by turning from the

3-26 right of [such] the centerline where it enters the intersection as close as

3-27 practicable to the left-hand curb of the one-way highway.

3-28 4. [When making] The turn is a left turn from a one-way highway

3-29 [into] onto a two-directional highway, [such turn shall] the left turn must

3-30 be made by passing to the right of the centerline of the highway being

3-31 entered upon leaving the intersection, and the approach [of such turn shall]

3-32 for the left turn must be made as close as practicable to the left-hand curb

3-33 of the one-way highway.

3-34 5. [When making] The turn is a left turn where both intersecting

3-35 highways are one-way, both the approach for the left turn and the left turn

3-36 [shall] must be made as close as practicable to the left-hand curb or edge of

3-37 the highway.

3-38 Sec. 4. The amendatory provisions of this act do not apply to offenses

3-39 that were committed before October 1, 1999.
